Suing USCIS due to extremely long ROC wait time [merged threads]

Hello everyone,

 

I would like to provide some of my case dates and get your advices, please.

 

June       2019, I applied for I-751

October 2020 , I applied for N-400

October 2020, I-751 was transferred to another USCIS office.

October 2020, I-751 was transferred to another USCIS office and has jurisdiction over the case

April       2021, interview for N-400 only ( I have been with my wife but even they asked me if my wife was there and see her, they only interviewed me for N-400 and I passed easily)

July       2021, interview for I-751 ( I went with my wife. They first only called me. Firstly, interview for N400 again and right after I-751. Later, they called my wife and interviewed her only. Another important thing is, after the interview, the guy told me that I had a red flag on my case, because I married with my wife pretty soon after the first meeting. We married in early 2016 and we have dozens of proof. At the end of the interview, they said, you are so unique and keep the relationship like this) . The guy told me that I would be updated in a month. But, it has been exactly 5 months and I have never heard anything. My case says ' interview was completed and case must be reviewed" .

 I called them to get infopass about 1.5 months ago and even my request kind of emergency, they said they don't have any enough appointment at this time. Call us back again next week. 

 

I would like to kindly ask, what I need to do, Filling a case inquiry or calling them again? Or going somewhere? Or anything?

 

Any recommendation would be appreciated. Thanks

August 31st, 2023: Oath ceremony scheduled.

I only called one time N-400 interview officially (with a paper) but when I went for I-751 interview, the guy told me that you have 2 waiting case. N-400 and I-751 and see that you have been on N-400 interview recently. We will start over. " Only repeated same questions but did not ask me 3 of citizenship questions.

the person that interviewed my wife and I, told us exactly like this at the end of the interview " you guys so unique and keep your relationship like this" .

Seems strange. A lot of people get married on their first meeting.  How much information/evidence was included with the I751?  This seems to be the hang up with the process especially since they interviewed you and your spouse separately.

I wonder also how their first interview was. But if they did CR1 did they have an interview? It just seems weird that they’d scrutinize them with ROC. That usually happens before.

I married in September 2016 and I got my first green card in September 2017. Also, my first interview was in September 2017 and they asked us a lot question, we passed clearly. I put the rest of the important dates at the beginning of this topic

 

The evidence that I sent,

- Debit and credit card joint account from 2017 and same accounts are active, mostly using. All our rent paid from this debit account.

- 2 auto license, purchased together and car insuraces together.

- life insurance

- internet bill

- we moved 3 times and all rent agreements together.

- we traveled to Cyprus together visited my family. 

- we paid all taxes jointly

- and a lot of pictures together. 

 

Also, one of another important thing is, I got a problem with a girl in my company and I got domestic violence, dismissed. She brought a lot of wrong info and I have never seen any judge, the case was dismissed. In the first N-400 interview they asked me about that and I explained. Not a detailed question. And they approved my N-400. On the I-751 interview, I did not asked any question about that. Only thing is, After a lot of question on the last interview (N400 again and I751 - combo) , at the end of the interview the guy told me that " you have a red flag on your case. hard to believe that you came here as a tourist visa and married quickly" 

I told him, I came here for a short time education and visit my sister. I  was willing to end up my short education to get an approval for higher education if possible. It was also hard for me to believe as well like quick marriage. I haven't married before and my wife also same. When I was travelling in CA I lost. She helped me a lot and she proposed me on the 4th meeting for marriage. The reason was I approved, I trusted her. " I said.

Overall, there is not much that can be done right now except to wait for either an RFE, or a decision on the I751.  The issue you had at work may have been the reason the IO separated you for the I751 interview, did they ask your wife about it when she was being interviewed?

The reason that I came as a tourist visa, I did not know I got an approval from university! That’s why I came as a tourist.I graduated!  
When they separated us, they did not asked any question about the dismissed case to my wife. After the separation, we got in together and he asked my wife. She said she knows everything and my wife said she believe me. It was totally 3 years ago and we forgot about that. 

the time for I-751 and N400 totally over the estimated wait time. So, your advice to me only wait?

You can try calling your Congressperson or Senator to see if they can get more details.   You can try contacting the USCIS Ombudsman.  Maybe others have additional suggestions.
