Hi, I brother applied filed for my immigration 14 years back, I just got approval, but now he refuses to cooperate as a petioner, I am fully capable to support myself and daughter financially , can I proceed without the affidavit of support and other documents of the petioner ? It says pay fee but I don’t want to pay and get stuck just because the petioner isn’t willing to proceed

I don’t think you can continue the process without ur brother. Better talk to him about this. Its family based immigration so he will be your sponsor. It doesn’t matter if you can support yourself financially

No. This is not a thing. 
 You did an approval of what? Do you have your visa on hands?

You said it, though if by ”live” you mean you have so much money that you don’t need to work then you can get an EB5 investment green card

Your daughter can probably get a work visa if she finishes med school and does the medical exams conversion (i presume she is not at med school in the US already?) and gets a US job offer, but that’s not going to help you live in the US for a long time, if ever.

There is no “legal point”. You need a sponsor in the right category. He is not obliged to complete the process if he has decided not to sponsor you after all.

Judging from first post the petition has been approved by uscis (maybe OP is confusing this with visa approval), he is now at fees and documents stage and his brother does not want to continue with the process. No visa.

The legal point is if your USC brother doesn't want to continue his petition for you, you can't immigrate through him. I guess the brotherly love has turned into rivalry in those many years.
