They do.  But, they also understand that an F4 sibling visa -- as one of the very few countries that even have this category -- that the visa is for family reunification.  If the petitioner is no longer willing to support the beneficiary's process, it is clear the family is not immigrating to reunify.

It’s not that they don’t understand it. By law you need a petitioner/sponsor for a family-based petition. If the sponsor changes their mind, or dies, or is unable to financially sponsor, etc, the process is dead in the water.

Why does this matter anymore? You paying the fees is not going to change anything if your brother won’t go ahead with the process.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If you think you have a chance to convince your brother to cooperate, then you can keep the petition/ NVC case alive ( need case number and invoice number ) by doing ASK NVC inquiry and just say “ I need additional time to proceed with my case”.  It’s ok to identify yourself as the beneficiary and use your email address , they will send you automated “ contact confirmation “ .

DO NOT pay fees, it’s a waste because they expire in one year, but rest assured all you need to do is send that inquiry once a year , and case will stay open …..UNTIL your brother agrees to proceed. 
 

Without your brother signing I-864 and giving NVC his IRS taxes and paystubs, it’s over. And be aware that he can also just write them a letter saying I want to withdraw as petitioner/ sponsor ( if he has not done it already ) …so you really need him .
