I-130 PD May 14, 2021 @ Vermont Service Center 

I-129f PD June 8, 2021 @ Vermont service Center too.

 

I have been made 3 previous expedites for my I130, the fist one I never got an answer but like a month later I call USCIS and they told me that it was closed because I never respond. Second and third expedite were denied. For my I-129f I already did 2 outside processing times (you can do a second one after 30 days of the submission for the first one) they keeep telling me that my case (i129f is under going an extensive background checks). 
 

On April 5 I made another expedite through a live agent and today I got the next response today. My question is, it is that a denial? Or I can consider that they will going to review my expedite and ask me for proofs? Please give any advise. The answers for my previews expedites were saying that expedite is denied but this one doesn’t said that.

It means there is no decision as of now.   Why are you repeating expedite requests?????  They already denied your expedite.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

They are going to be denied, unless you present different reasons of why they should grant you the expedite.

Expedites are usually granted only based on a need for the USC and it has to be a compelling reason. Pregnancy and a newborn are not reasons (just saying)

I file for expedite because I was anticipated that I will have financial lost. Before I got a unemployment benefits due to COVID and then with my pregnancy 🤰 I did not find a job after those benefits end.

This last expedite I did it because I have 2 children, a boy of 8 years old and a baby of 3 months old. I’m a college student with no job. I’m living right now of charity from church or nyc programs. I can not go and find a job because I don’t have money to pay a babysitter. My college class will start on august and I don’t know what to do with all that goes on in my life. I don’t have a family here in USA that can give me a hand and I’m feeling depressed.

The problem with your expedite request is that you are his primary financial sponsor (or have a joint sponsor) that has to be able to support him financially after his arrival. Your expedite is basically asking for him to come to the US faster so he can work and support himself and you but this is contradictory because you and/or the joint sponsor have to prove that you can financially support him without him working. How will you show the IO that your husband won’t become a public charge and that you can financially support him? And how could you be sure he’ll find employment as soon as he gets here? These are questions that they are asking when reviewing expedite requests. 

My father will be my joint sponsor. He makes more than 75,000 a year but the thing is that my father is an old man. Sometimes he give me some money for food and stuff but since I’m 33 years old he doesn’t have responsibility of take care me.

I'm sorry about your hardships. Please know that I come from a place of understanding. But the issue is that you signed to be his main sponsor (even with a co- sponsor) so you swore to the gorvernment that you were going to be financially responsible for him. With your reason for expedite you are essentially telling the government that he needs to come to support you. It would also help us help you if you accurately filed your timeline, because your profile says CR1 but you talk about an I-129 F, which is for K1

My timeline is correct. I have an I130 from May 14 2021 and and I129f from June 8 2021 filled at Vermont service center. I understand your point for public charge but I know many people who did not work and file for family members and they find joint sponsors to full fill the requirements for the affidavit of support.

Right. But that's following USCIS guidelines: if you don't make x amount of money for your household size, you have to find a joint sponsor. Those people you mention have to do that, otherwise their petitions will be denied. Your case is different because you already have a joint sponsor, but you're basing your expedite based off on the immigrant coming to support you. You can still try, but if they denied you so many times it means that on their end, the need for an expedite is not that urgent.

When in doubt, always read the USCIS manual. Chapter 5 is the one that deals with Requests to expedite Applications or Petitions. It seems that there is a chance of filing an expedite for financial loss to a person. It says:

 

  • Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure: (1) to timely file the benefit request; or (2) to timely respond to any requests for additional evidence;[3] They said you did not respond to an RFE they sent you, is this true? Why didn't you respond?.

Also, further down it says

Job loss may be sufficient to establish severe financial loss for a person, depending on the individual circumstances. For example, the inability to travel for work that would result in job loss might warrant expedited treatment. The need to obtain employment authorization, standing alone, without evidence of other compelling factors, does not warrant expedited treatment. I don't know that you going to school can be paralleled to this?

I wouldn't look to much into this. Mine said that there was a case status update a few days ago, and there was nothing.

I wouldn't look to much into this. Mine said that there was a case status update a few days ago, and there was nothing.

I will wait to see if Uscis going to send me a denied email. If so, then I just have to wait for the normal processing time that right now is 12 to 16 months. I want to work but is cane a difficult with having a baby and not have money for babysitting. I will continue pray for a miracle.
