I just went through this process, my fiance at the time was visiting from EU on a esta tourist visa, we were going file for a k1 but a lawyer told us there is no issue getting married on a tourist visa if legitimate circumstances arise, she was pregnant and covid closed the borders and forced us to make a decision, we got through the process no problems. There are no red flags if your relationship is legit, uscis goal is to catch fraudulent marriages not to force legit families from being together, so get married if your circumstances can be explained, lastly it is not true that you can't leave the country if you have applied for AOS, that's only true on a K1, until your case is decided on you can still travel back and forth on a tourist visa to see your son, your son could also travel on a valid tourist visa. You can also apply for "advanced parole" during the AOS process which gives you the right to leave the country while you papers are in process, good luck

AOS is AOS

If you plan to adjust status you can't leave until you get AP. 

The only time you're allowed to leave and return on ESTA or B2 is when you're planning on consular processing. 

(K3 doesn't require AP but that visa is all but obsolete).

Just for the sake of clarity, if you are doing AOS from a dual intent visa like an L1 or H1B, you can leave the US while AOS is pending before getting AP. I know we're talking about people on B1s and VWP but I just wanted to point this out.
