Hello all,

So in October i submit an expedite request to NVC regarding my case. I am the petitioner and my wife is the beneficiary, in October we had our first child and last year when there was greencard ban i also applied for citizenship. I knew after the birth of my child that my citizenship interview in around the corner. So, yesterday i became a citizen and was planning to change my wife's petition and apply for a new i130 for my child but this morning i got an email from nvc that my expedite request is accepted and my case is transferring to the local consulate. 

My question is what should i do now? Should i let the embassy give me a interview date and then explain them what happen or should i do something else. 

Any help will be highly appreciated.

Well yes you need to advice the consulate and you now have a child to petition.

Should’ve delayed oath taking until family in the US. The only other thing to do now is file I-130 and see if USCIS and NVC will expedite it.

Thank you for the reply, i had tried 2 times before and was refused, this time if i had known that they accepted my expedite request i would have delayed my oath unfortunately i got the request approved email day after my oath ceremony. If i had delayed my citizenship interview i would have delayed my n400 next interview until God knows when due to backlog of n400 applications. My bad luck that the acceptance email came 24 hrs late.

Email the embassy and request a later date. Explain the situation you are waiting for babies petition to catch up. That way they can act now and be able to give the space to someone else.

Not a good plan, at least you would be with your family/newborn together while waiting for N400 interview but now you have no idea when your new born and your wife (if not leaving the child behind) may immigrate, in 1-2 years. 
 

Anyway, file i130 online for your child ASAP. Then request for expedite and hope for the best.

 

Regarding your wife's interview, email embassy regarding the change of situation and ask to hold on for the interview till your petition for child's goes to interview phase. They may or may not oblige.

It's very important that the wife not be issued a visa until the child is ready.  Request to delay your wife's interview and explain why.
