Make a mistake What to do?

Hi All,

 

We realized we make a stupid mistake by only sending one passport pictures in our I-130 package. We mailed it today, we tried to cancel the mail but they say it already sent. What should we do???? Please have anyone ever experience something like this before? we just can't afford to get deny/RFE over this silly mistake

Why can't you afford an RFE? Shipping one single photo won't cost you much.

You might not even receive an RFE, just wait and see what happens. An RFE is not that big of a deal anyway, and your case won't be much delayed at all if you send the response immediately after you receive the RFE

 

Nothing else you can do but wait and see. Unless you sent a check with your package and you cancel the check so they can't accept your application. But that will likely delay your case even more than just a standard RFE, so no point in doing that. I believe it takes over 30 days to receive the package back after a rejection, and then you'd need to refile.

might not receive an RFE? they will let it slide? or get rejection ?

if cancel the check why it might delay the case even more? If we get rejection will they return everything back include the check? to refile can we just sent everything back and the missing passport picture ?

I wouldn't cancel just because a passport picture is missing. 

 

As @Scandi already said, you might not even get an RFE for such a minor thing; and if you do, it won't delay your case that much.

 

Try not freaking out, the process is already stressful enough. Be calm, collected, and positive.

There's no point. No one will have access to your package until it arrives, it is checked, scanned and a case number generated.

 

And just to clarify: you entered on a K1 visa but you decided not to adjust status but to return to your country and apply for a spousal visa?

Once they received it and send us the receipt number, can we call them?

You can but I don't think it will help. 

 

If a single passport picture missing was extremely important, they would actually reject your package and return it without generating a case number. 

If they don't reject it because of the missing picture and both pictures are necessary, they will ask for it in due time -some months from now-. 

 

Really, don't get stressed now.

Relax. There is nothing you can do at this point. When I submitted my AOS I forgot a couple of passport pictures. I did get a RFE, but not for that. And it didn’t even delay my case.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

They'd probably just let it slide. Only time I've seen an RFE for pictures was for an AOS of a 11 year old since they're exempt from biometrics.

 

Also if this is for AOS, they will definitely let it slide since they just use the ones from the biometrics appointment.

Contradictions without citations only make you look dumb.

One passport photo of the petitioner is sufficient.  Unless the beneficiary in in the USA when filing, zero passport photos are needed for them.

Facts are cheap...knowing how to use them is precious...
