CR1 approved 1 month before IR1 status

Timeline

Hello, I am wondering if you get your Visa approved a month or two before your 2nd anniversary, can you wait until after that anniversary passes and then travel to USA and get a 10 year green card instead of the 2 year card?

Yes.  I advise to do exactly that if possible.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

My only concern is that an acquaintance did just that a month ago and the CBP Officer stamped it someway as a 2 year visa. She asked the officer “shouldn’t that be a 10 year visa” and he said “do you want to see your husband or not “?  So she didn’t want to risk anything and just left.

If the wrong card is issued then file Form I-90 for free because of DHS error: https://www.uscis.gov/i-90

 

See 8 CFR § 1235.11(b): "Correction of endorsement on immigrant visa. If the alien is subject to the provisions of section 216 of the Act, but the classification endorsed on the immigrant visa does not so indicate, the endorsement shall be corrected and the alien shall be admitted as a lawful permanent resident on a conditional basis, if otherwise admissible. Conversely, if the alien is not subject to the provisions of section 216 of the Act, but the visa classification endorsed on the immigrant visa indicates that the alien is subject thereto (e.g., if the second anniversary of the marriage upon which the immigrant visa is based occurred after the issuance of the visa and prior to the alien's application for admission) the endorsement on the visa shall be corrected and the alien shall be admitted as a lawful permanent resident without conditions, if otherwise admissible."

Absolutely, yes.  However, sometimes the wrong card gets issued.  If it does, file an I-90 with no fee to get reissued correctly.

Which port of entry is this? Sounds a bit hostile to be honest. 😢
