Timeline

I have a couple of asset and income issues to resolve.  My wife and I own a house together in her country.  I realize that I can't own property in China but my name and passport number are on the house documents.

 

1.  Do we claim it as joint ownership and if so how do we do it. We claimed it as joint ownership in the I-130 application as evidence of co-mingling of finances.  I presented translated documents of the house and my financial contribution to the property.  I don't think I should change the claim mid-stream. 

 

2.  To show joint assets do I need to file a I-864 on her too?

 

3.  She has a small income and I contribute a monthly amount to that to keep her from having to work all kinds of hours and 7 days a week.  We do the transference of that monthly support through monthly bank transfers.  On the I-864 can we report that as income?  Do we need to separate out the 2 streams of income and how? (We can back it up with bank statements.)  

 

4.  She has some savings that until now she kept in cash.  She recently put it into the bank so that we could show that she had some money.  If we show it as assets would that be frowned on since it is essentially a new account and does not show and long term saving of money.  I know in financing of homes in America, lending institutions would frown on this kind of evidence.

You are asking about your wife's income, is she the petitioner?

Responding in general that'll be applicable for all of your questions.

You will fill in i864, not your wife.

You can't include your wife's income from China unless that income continues after she immigrates to the US. You sending money to her can't be considered as her income. That's already a part of your income.


You can include hers or joint assests in your i864. Yes a recent large deposit would be suspicious for sure. You can also include cash equivalent of the house in assets if the house can be sold within a year and all the cash from the sale can be brought to the US. Some countries have limits on how much one can bring when leaving the country.

I would have also asked if your income is sufficient.  If it is, leave the asset section blank.  If your income is all W2/employee income, use the I-864EZ that has no asset section.  This information is in the form instructions, along with how to handle applicant income and applicant assets.

Don't know why you choose to insult people.  I don't argue with people; no point in it.  I ask questions and would like the questions I ask to be answered rather than you answer what you think I need to know.  I didn't ask for advice.  If I had wanted advice I would have asked for it.  But you can bet that I won't ask for it now.  Your caustic comments rather than assistance for the question asked is absolutely unnecessary and harmful to to new people coming to this site looking for assistance.

People coming to this site are looking for info.  They come from all walks of life that you can't even begin to understand.  They are, once like you were, not understanding the process as well as you.  I am betting they didn't take opportunities to make less than helpful comments about where they stood in their understanding of the process.

 

I would like to suggest that from this point forward that your best approach is to answers the person's question then if you think they need some guidance to offer it.

There lies your answer.

(We can back it up with bank statements.)                       As a spouse you giving money to your wife is not another stream of income. It is the same money in the same household. If you give her $100 from your bank account then you have $100 less and she has $100 more for a net gain of $0. You would include any income you have. Her income cannot be counted unless it will continue once she moves to the US.
