K1 visa: college admission deadline to expedite the processing

Hello 

 

we have been waiting for k1 visa for 28 months. We were planning for my fiancée to start college in Fall semester so she won’t lose half a year without education. Unfortunately, we don’t know when the US embassy in Tashkent Uzbekistan will start working. So I was wondering if I can obtain admission request from colleges for my fiancée for Fall semester that can be used to expedite the k1 visa processing. Does anyone have any experience with that?

You can try but expect it to be denied

It cost nothing to try, but will they think that is a good reason to move your case to the front of everyone else who has been waiting longer than you?

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Timeline

Make sure you research out of state, in state, and international student tuition.

Doubtful she will qualify for instate as most colleges require a 6 month or 12 month residency.

Since she won't have her green card for quite a while inquire as to how her tuition will be charged.

You can try for sure, but it doesn't sound like a good reason for expedite, because K1 visa is not for going to school and I would assume USCIS would think along the line that she should have applied for an appropriate student visa if the main goal is to go to school.

Agreed it isn't a compelling reason for and expedite,  but not for the reasons you mention.  First, the USCIS is not involved in a F-1 visa decision at any time.  Secondly,  a K-1 is an intending immigrant and absolutely can go to school because they are going to be living here.

Hmm I see. Not sure why I thought that all visas need to go through USCIS

What an odd statement. A K1 visa is not for just sitting around doing and nothing for the rest of your life! And an F1 visa is not appropriate if the intention is to marry and stay here. Of course someone who is going to stay here can be expected to want to study or work or do whatever anyone who immigrates somewhere can normally be expected to want to do. I don’t know if the expedite request will be successful, but if it’s not it won’t be because they don’t think a k visa holder should study.

I think it comes down to K1 vs CR visa choice and unfortunately K1 has the sitting around factor going for it until you get the EAD.

What does the EAD have to do with attending a college or university?  EAD is a work permit.

I was not talking about the EAD in the context of going to school. If you reread my reply I was answering to SusieQQQ's post that until you get the EAD after you file for AOS K1 involves a period where u r limited in your choices. (Work, getting a DL)

You don’t need an EAD to study. Your post had implied there was something intrinsically wrong with wanting to study after coming in on a K1. Just, no.

 

Edit anyway you clearly realize what you wrote was silly (because now you’re talking about should have gone for CR and dropped the should have gone for student argument). Pity you can’t just admit it lol rather than tying yourself in knots trying to justify the post !!

I said that I do not think that it is a super solid reason for an expedite that she does not want to miss out on the fall semester. I did not say it is wrong to study on a K1 while waiting on AOS/EAD.  Sorry if I caused confusion.
