I accidentally chose the answer for the "Is your fiance(e) related to you?" question as "N/A, beneficiary is my spouse." He is not! I've never been married and they are asking for me to provide a divorce decree! I feel like such an idiot 😭 What do I do? Please help me!

That is an unfortunate error.  It is very difficult to prove a negative. You may be better off marrying and refiling for a spousal.

In my opinion. to make a statement and have it notorized that it was a mistake. My case was different. I couldnt produce a deposition for a criminal record of mine because it was no longer available. it said for me to make a statement and have the court provide a statement saying it was no longer available. the court refused to do it even if I had the police arrest record. So I made a statement saying it wasnt available and got it notorized and sent it  they approved my petition. at least you can try that.

Criminal records and Marriage is super different things.

For the K1 the person need to free to marry and since the OP answer,  he will need to provided some proof. That he does not have it. He can try to explain but credibility is hugely important in any imigration application.  

 

@LFG I would suggest the same of @Jorgedig or you can find a lawyer, spend money to get maybe the same answer.

Yes, I actually contacted the County Clerk and they are able to provide proof that I have no marriage record through the Single Status Affidavit. I am going to provide that, my fiancé's Single Status Affidavit, and a notarized statement acknowledging that it was an error, therefore I cannot provide a divorce decree since I am not married. 😓

I am not even sure if I am using the word correct. I have a Single Status Affidavit that was certified by the Clerk of Circuit Court, but I don't know if I have to get it apostilled. It's not going to be used out of the country since I am the petitioner and live here, but I just want to make sure I don't.

 

If anyone has an answer, I would greatly appreciate it!
