So I got the standard rejection notice, I attached it to this post. I have gone through this and I believed I submitted EVERYTHING. We have a copy of our NOA approval, his visa from his passport and an original Marriage Certificate that shows we got married within the 90 days. The only issue is that we filed after the 90 days. Could that be the issue? Do they want me to file an i-130 now? I also attached a photo of my NOA for reference. Is this the correct NOA? Also, I did research when we were filing it out and saw people saying that K-1 visa applicants don't have an A-number so I left that blank. Now that I'm looking at my NOA again, is that the number next to the beneficiary?

 

We filed a i-485, i-944, i-846 & i-485 and yes, I put the correct designation in i-485 Part 2 -> C. 

 

Please help, I've looked this thing over front, back... every which way and I can not figure it out. I saw on another post that someone suggested making an appointment but I doubt they're letting people do that during this pandemic. For reference, I am an American born citizen and my husband is a Canadian Citizen. We live in California. I really appreciate everyone because this process is INSANE!!! Thank you all!!

I'd refile it.   The A number is on your NOA2    Yours starts A201-

Thank you guys! I'm feeling a lot better! It won't let me edit my post so I'm going to try to report it and then repost.

 

For the time being, does anyone know if filing this late after our 90 days won't be a factor? He entered the US in November.

No not an issue.  

But the forms you labeled in your first post are off.  Can you recheck what exactly you sent, if you sent a copy of evidence with each, your NOA2 copy from the K1, etc...

A lot of people got rejected lately, even though they said they filed everything correctly. So nobody knows why USCIS rejected them.

 

Just download all the forms again, fill them out and send it again. 

 

You didn't mention 765 and 131 on your post. It's highly recommended to file this forms too. They're free with AOS, and your spouse will most likely get the combo card before the interview and will be able to work and travel.

Mine had got rejected too. I thought because I checked 2a instead 2c in part 2 of 485. Letter asking for I-130 made sense in my case. Still I called them but they said they cannot discuss mistakes I made. I asked whether same documents would do that I believe don’t have mistakes. They said yes. So I re-printed 485, kept everything else same and re-submitted it. They received it on Friday. Finger cross now.

I noticed the same thing too from reading the forums. Most if not all of them are those who filed I-944s too. 

 

Do you the rejection has anything to do with the information OP put on the I-944 (or lack thereof)?

Maybe there's a certain criteria in the I-944 that you have to make, based on how much of a potential "public charge" you can be, which they never mention?
