Hi all,

 

I’ve been living in the US with my boyfriend on a F1 visa, studying English. I am from Switzerland and we both went there to visit my family. On the way back to the US, I was sent to secondary at the us port of entry. They harassed me with questions, searched my phone, only found out I had a boyfriend. The officer eventually made me say I was doing a little job on the side without finding any evidence just by pushing me to say something like that. They cancelled my visa, sent me back home and told me I should re apply for a correct visa such as K1 if I were to marry my boyfriend or working visa but I don’t think I could find any sponsor for such visa. What should I do at this point?

This seems to be happening more often. They’re really cracking down on people violating their student visa terms by working on the side. A “little” job is still not allowed.

Not sure there’s much you can do if you admitted to a CBP officer that you were working against the terms of your visa. Is your relationship with your boyfriend serious enough for marriage?

At this time i don’t think they will issue any on immigrant visa to you. If your two are serious in relationship, may be pursue K1 visa or CR1 by marrying.

 

I have also heard they are cracking down on the students who initially come to attend a 4-yr school but transfer to some low key institutions in the name of learning English like TOEFL, IELTS requiring only limited classes and stay here for a long time. 
 

Is your case similar to those?

I don't think you will be getting another non-immigrant visa of any kind for a very long time........It should have no effect on a K-1.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Are you implying that an officer made you lie saying you had a job when you didn’t? because that is a very serious thing to allege

 

Or did you in fact have a job that was in violation of your student visa?

Yes I know that in my case a student visa is no more an option for me. I met my bf in 2016 while I was spending the summer in the US. I went back to give our relationship a chance. It’s been 2,5 years and we are in love. All I want is to be with him.

Seems a K1 or CR1 is the route for you to go, then (assuming the boyfriend is a US citizen). As above, the denial of entry/cancelled student visa won’t affect those types of visas.  Good luck.

Too bad. Forget about returning to the USA as a visitor or in any other non immigrant visa except perhaps H1 which allow dual intent. You should not have admitted what wasn’t true and at this point you can’t go back and change it, your records are set in stone and you signed that document he gave you.

 

If/when you guys get married or engaged, he can petition an immigrant visa for you.

If you both decide marriage is in your future, he should join us here.  First, you should decide whether a K-1 or a CR-1 is right for you.  Then, studying the guides on this web site would be a good start.  This info might be useful:

 

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1
    Slightly faster arrival in the US 
    More expensive than CR-1    
    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
    Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)    
    Spouse can not work until she/he receives EAD (approx 5-6 months)    
    Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
    Spouse will not receive Green Card for many months after Adjustment of Status is filed.

  

CR-1
    Slightly slower arrival in the US 

    Less expensive than K-1    
    No Adjustment of Status(I-485, I-131, I-765) required.    
    Spouse can immediately travel outside the US    
    Spouse is authorized to work immediately upon arrival.    
    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.

    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

In the sworn document I didn’t admit to anything I just ended it. That’s the only paper I signed.

In any case, I do not want to apply for a non-immigrant visa again.

When you sign an immigration document, you’re admitting under oath everything in it is true, unfortunately.
