Can I still apply for ESTA after abandoning AoS Application?

I'm living with my parents right now and they help me out a little. I'm looking for a job right now but it's not easy to find a job in Germany. There aren't many jobs and people have high expectations. Even for a job at a grocery store they want people with a good high school diploma. All the stores are overcrowded and everyone has to be very fast. It's very different here. I even think working in the US might be easier for me because it's not that hard to find a job. And there are less people if you don't live in a big city.

I guess it will depend on what you want to do as a couple, and prepare yourself for the fact it may either require some major changes to which country you want to live in, in order to actually have a life together, or potentially waiting a couple years until your financial situation sorts out for the better.

And when you apply for ESTA they ask you a few questions and one of the questions is "have you ever been denied a visa". And I'm not sure if that's a yes or no for me. It says my case has been denied, but actually I'm the one who canceled and abandoned it. So it should be a no.

Your ESTA is no longer valid. Your circumstances have changed since the initial approval. Anytime the circumstances change you have to re-apply.

For now, since you aren’t immigrating at the moment maybe it would be better to work on yourself and build a case that you won’t become a public charge once you plan on immigrating. Finish your HS diploma and get an entry level job say in a restaurant or retail. 
Your chance of a tourist visit seems slim since you have already shown immigrant intent.

That's not a bad idea.  It would get you some good work history, and your wife might find she likes Canada better (not as much change).  It seems like you're on a journey to live together at the moment, and I wish you all the best.  You seem to have some creative ideas and an ability to work around problems, which are great traits!

On J visas.  Spouse won DV lottery while in US.  Did AOS from the US.

 

Boston field office, GC holder for 10 years.

Citizenship received in 2016, took ~5 months from application to passport.

Spouse received citizenship in 2019

Why are you happy to work in Canada but not in Germany? 

 

Have you considered some form of home working? Customer service or something? From what I’ve seen here your computer skills are excellent and so is your English competence. If you can spend all day typing on her and answering people’s questions, why not do it for a company and get paid for it?

Our case was a little complicated. It would take too long to explain the whole story. All I'm asking is if I can visit my wife for maybe 2 weeks on ESTA. Or can I never go back on ESTA again because I abandoned our case?

That's all want to know.

It will be a lot easier for her to visit you.. give her the money you’ve saved for your flight to get a ticket

Seems odd that $535 for the I-130 is out of reach but vacations are not. Considering they were going to go through AOS which involves a long period of time with no possibility of any income from the immigrant, it’s strange that the I-130 filing fee seems impossible. 


Id’d sell the blood from my veins to get the money together to file the paperwork for my husband and me to live together if that’s what it took.

Agreed.. but op is confusing.. first vacation using esta, then on about immigration, then work holiday to Canada.. there’s definately immigration intent.. i130 is best chance, but the petitioner and beneficiary  will both have to work in harder in order to get approvals.. seems they are looking for easy solutions when there really aren’t any.

the filing fee, NVC costs etc will be very close to the same price of a flight to go visit her.. with the added bonus that you’ll have 12mths inbetween payments to save up for it, for her to find work and for you to find a sponsor.. 

 

seems your making excuses.. there’s no easy options here.. you think moving to Canada will be cheaper? Seriously

The I-130 filing fees is the biggest expense in the immigration paperwork. NVC fees are smaller (but you about a year to save up for those after submitting the I-130) and you will be able to work the minute you arrive. If you go there on vacation, you spend money on a ticket, can’t work, and you’re no closer to living together with your wife than you are now. All you will have gained is a few air miles and maybe a tan.

But how would that work without a sponsor?

 

And where should we live? She lives with her parents right now, but I couldn't move in with them. So we would need our own apartment and pay for a security deposit. Thats another $1,500.

 

And I think I should save up at least $5,000-,$6,000 before I go. Just to make sure I have enough money if something unexpected happens.
