Timeline

Hello all 

When my fiancé  applied for his tourist visa, the agency put down he was COMMON LAW MARRIED to the mother of their child.  Due to this we got and RFE.  How or what do I need to do to clear this up.  With common law we know that there is no record so no record of divorce.  I am at a loss any advice PLEASE!!!!!!!!

Did he lie on the application for the tourist visa? He may have a lifetime ban for misrepresentation. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

He would have had to sign it, swearing it was the truth the whole truth etc etc.

Does not matter if an agency did it.  He signed it, and is responsible for the contents.

In the US if you're common-law-married, you'll need to obtain a traditional divorce before you can remarry.

How do you end a common law marriage in Jamaica?  Does Jamaica have some sort of singleness certificate?

 

When he did his interview for the tourist visa he swore an oath to tell the truth.  He swore that the visa application was correct.  So twice he lied, in one interview. He signed the visa application under perjury.

March 2, 2018  Married In Hong Kong

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Did he receive that tourist visa?

I had this happen to me also. Me and my fiance worked together and he got statement of Singleness from an attorney.He got certified and he signed. He also got a letter from all friends and family that we are single and we both have a loving relationship. Signed and dated by all family and friends.

To the individuals that answered my question with out trying to be extra nosey thank you.  I have him now going to get a certificate of non marriage.  Calling USCIS today to see what else is needed.  Never was placing blame on agency was just information.  Like many stated at the end it is his fault. Life lesson learned....JulesNBloom thank you for insight will be getting family letters as we wait for certificate.

To my knowledge nobody in this situation has ever come back and told us what happened and how they resolved this. I can not help but think CR1 would be the way to go, normally I would anyway but especially with this sort of issue to deal with.
