December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

What does it mean in practical terms? The USCIS still asks for new forms. Even if judge blocks the enforcement of the rule, you are still expected to use the new forms, unless USCIS specifically says not to. And they can refule to accept the forms if they are not correctly filed.

I haven't looked at the I-485, but there doesn't seem to be any major changes to the I-864. Honestly, there doesn't seem to be *that* much difference between what they are doing after the 15th and what they were doing before is there? I don't think anyone was ever supposed to be a public charge anyway. Aside from the totality of circumstances and the favorable and negative factors, I don't understand what the changes really are. Am I missing something?

The I-864 instructions appear to be identical except for a small note.  But have you seen the I-944?   It is totally new, and it digs into debt.......a totally new area.......

But you are correct in that the public charge issue is not new....and this judge's decision will probably mean little in the long run, imo.  We shall see.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I did see the I-944, but if I'm correct, that only applies to the beneficiary/immigrant which the majority of them seem to be all coming from K-1 or Spousal visa's yes? So not a lot of time to establish much debt/credit, so it still doesn't seem to be that much of a difference? It seemed like everyone was freaking out and scaring everyone but it's just enforcement of rules already in place from what I can figure. I did notice the injunction, which I see both sides of the coin so we'll see what happens.

Yes you are missing something look at the new form I-944!!!!

That's the pitfall IMO the administration knows full well a new immigrant does not have a lot of what the new form I-944 is asking for so a lot of those boxes will be blank and or a No. Don't you think that will used against them one way or the other?

New editions of I-485 and I-864 were removed as well.

Hopefully this will stay in affect for awhile. I'm definitely happy about not having to fill out another form and include a lot of extra evidence.
