I don't know what her class of admission is. You have already found the I-94. Make sure you follow the guides at the top of the page for adjusting status from inside the US. Quite true she cannot leave the country or work until she has her EAD or AP. If she leaves she has abandoned her AOS. I certainly hope you were able to procure a job that meets 125% of the poverty guide line for a family of four with your spontaneous decision to move the family here. You will need proof of that current income as well as the past three years tax returns.

She will also need her medical exam and other things......so read the guides, several times is recommended.

How do people do that with jobs, bills and kids in school? You just send an e-mail or call your boss/school/family to inform them you’re not coming back from your vacation or trip? How on earth does that work?! And this is a rethorical question 😊

 

When I was in The States last year and met with our lawyer and I was informed that I could just stay, marry and adjust status (which would be perfectly legal) I thought she was crazy! 

 

It always puzzles me when I read posts like that.. 

 

 

I also picture airport parking lots all over the world with cars gathering dust and eventually being towed for overstaying the 2-week time limit, pets with sitters waiting for owners to return, unopened mail gathering, work piling up on desks and people getting an email saying “decided to stay, please pack up all my stuff, ship it the US, clean the apartment, return the keys to xxx, wire my returned security deposit to me, cancel my utilities, sell my car, close my bank account, return my company property to my employer”.

 

I know of 4 people who have done it. One of them I work with. In each case it was actually planned. One sold a house and held a massive farewell party. Another brought 2 cats with her.

As far as all the other people commenting about my situation, I was not asking for opinions.  I would think this forum would work best if people are here trying to help each other out and not providing comments not related to people's questions.

You will find that people here are sensitive when it comes to others jumping the queue.  Many of us have had to wait months or years to do what you did on a whim.

But even though we've had to wait, at least we don't have to worry about what the outcome will be, because we've done it by the books, and there isn't any penalty for doing it strictly legally. Potential rulings of Visa fraud are nothing to take lightly. This is a process that needs to be done very legally and strictly by the books, or bad things can happen later. As immigration laws toughen, you might just see "queue jumpers" get sent back. Don't think it's not possible. The laws are changing, and it's possible older cases that seem fine now might come under scrutiny later, with bad consequences for those involved.

I have no personal objection to the express route, the only major issue I see is if it breaches the VJ ToS, my Bible, should be yours.

 

However expecting me to believe that you come with your family for a Holiday and decide to stay, well that is pushing it.
