Tax return please help!

Hello everybody and I’m sorry for

bothering....

 

Would only the last tax return be enough to satisfy the requirement for the visa application. He did not file a tax return the year before because he was living in Germany and before that he filed it with his ex wife.

 

Can he provide his pay stubs from his employer for this year along with last years return to satisfy that requirement?

Living in Germany is not a valid reason for failing to file taxes.  All US citizens and/or legal residents must report world-wide income.

He is a german citizen who was living in Germany and who’s income was earned in Germany, therefore he did not file a US tax return

Was he was a dual citizen that year? He can file the late forms with the IRS: https://www.irs.gov/businesses/small-businesses-self-employed/filing-past-due-tax-returns

Yes he’s mom is German and his

dad is American so he has both citizenships

Dual citizenship or not ... USC must use the tax return to report all income even if no tax is payable because of the foreign earned income exemptions

This is the minimum requirement on the I-864 instructions--most recent tax year (2018) return plus W-2 OR IRS tax transcript (preferred), plus six months of most recent pay stubs to show current income.  Sometimes they like to see other years of tax returns or transcripts, plus a letter from employer to confirm current income, but these are not required and you won't know until the interview if they want to see them.  NVC just checks off the boxes of what is required.  I assume you're at NVC stage, so you can upload the minimum documents with the I-864, or include more to be safe, it's up to you.  We uploaded the most recent tax year IRS transcript available (2017) because 2018 wasn't ready yet, and we are taking the 2018 return (filed as married jointly) plus a W2, or tax transcript if it is available, to my husband's interview in Rio on June 12, and I will take the other years with me in case they want to see them.  We also uploaded a letter from my employer confirming my current income.  Good luck!

even though his foreign income is exempt for well over $100,000,   as a USC he must pay into medicare and SS on the foreign income

I used this to do prior years taxes before moving back to the USA https://www.freetaxusa.com/prior_year.jsp

 

I did them online and printed them out and mailed them. 

 

And if if you make under the threshold on form 2555 you will not owe anything. I think it’s over $100,000. Essentially all of your income gets reported and zeroed out so no tax due and no problem filing late.
