Mother of US Citizens (children) wants to move to the US

Hello everyone,

 

I have a friend whose two kids are US Citizens and she was wondering if there's a legal way for her to reside in the US. Anyone has any experience with that?

The kids must be 21, agree to it and petition.  Lots of people have experienced this

We already do have anchor babies left, right, and center. It just takes 21 years for the baby to fill out the application paperwork for the parents to benefit. Here's an interesting link to statistics from 2018.

lol, according to their methodology they would deduce that I am an illegal immigrant. They don't seem to understand the concept of certain types of green cards apparently.

 

Never mind that illegals may have babies here just because they live here (even if illegally),  rather than with the intention of being used to file citizenship for parents - which is how i would define an anchor baby. I would think there are more anchor babies by this definition among Chinese birth tourists (all legally done) currently back in China than among some illegal populations, for example.

Oh I agree. Most of the data that I found on a quick search does not include that much detail. Instead they prefer to frame it as a legal/illegal immigrant situation. I'm sure there is data somewhere that shows birth tourism data  where the mother had legal entry and then returned home after the baby was born. Not sure if there is any data that specifically pertains to the number of those babies who later as adults move to the US and petition their parents. Probably it's in the I-130 stats.

Well, there’s much more to what goes on than interviewing a few people. You may have seen some articles earlier this year about arrests in connection with birth tourism -

 

“The businesses coached their clients to deceive United States immigration officials and pay indigent rates at hospitals to deliver their babies, even though many of the clients were wealthy, investigators said.

...On its website, Ms. Li’s company touted the benefits of having an American child, including a “most attractive nationality;” “priority for jobs in U.S. government, public companies and large corporations;” and the opportunity to immigrate to the United States once that child became an adult and could sponsor a parent for a green card.”

The children, when they reach 21, will also have to live in the USA. At least for the amount of time it takes for them to petition her and her visa to be granted. If they have no interest in living in the USA (and if they’ve never lived there before and are perfectly happy where they are then why would they?) then it’s game over for the mother and her plans to live here.

 

The IR-5 is a family reunification visa to allow parents of USCs to move to the USA to be in the same country as their children. It’s not for people whose children happen to be USCs living elsewhere to be able to start a new life for themselves without the children.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

How did she enter the US? How long has she resided in the US?
