People have filed in 5 months and gotten thru.  I would suggest 4 to 6 months js enough.  I filed at 14 months as I was not even aware of such a process. We were one of the early applicant when this all started.

4 months is enough wait, the process itself will take 2 months . Demanding an answer in 6 months is fair. Also, they are just delaying it for no purpose. Once wom is filed, how come they are finish all the processes that they couldn't in 18 months and even 20+ months for some. 

Waiting more than 4 months is not worth it. I have helped quite  a few people and was also following up with many of their statuses. 

I feel the pain for people who and waiting and that is why I am giving my sincere advise. 

Go for it at 4 months and of course consult with your lawyer.

Thank you so much for sharing your informative experience. I appreciate it. I will follow your advise. Do you know what factors does the wait time depends? I would like to know because the person who got interviewed 1 week before my husband also was given ds5535. It's same embassy, same category cr1, and both petitioners are USC. His wait was only 3 weeks. That gave me a hope that DC is working but sadly we are still waiting.

There is no set pattern that I could figure out while I was waiting. I am sure the lawyer will say that same. This whole process seems to just an excuse to put people wait randomly.

What are the consequences  if they make decision not in your favor?

 

isnt DS5535 background check. If embassy don’t have background check on applicant you think court will say it’s fine? I can understand if someone was missing docs & they were just being pending review. All staff had to do is review & approve. But I see risk with ds5535 WOM

I have only seen one return after filing a WOM but they knew it was  to be returned anyway.  They do not return because background checks are incomplete... that is a myth.  I have not seen one returned for that reason.  They must make a decision the day of the interview the ds5535 is given when they don't feel ready to make the final decision.   Its a temporary denial but I have rarely seen anyone who gets one get a full denial later.  It almost always produces a visa sometimes weeks sometimes years.  You file the WOM when you are ready and it feels right.

Thanks, I m already a member in that FB group. No responses to my ds5535 post. I searched that group, I saw old post form 2018, 2017. Maybe one in 2019. If they are handing these out randomly 1 person per son consulate each month then I would expect to see more posts, like AP topic on missing docs etc. I don't see any discussion on this topic.

I think there were more given out in 2018 for some reason.  Everything was very active back then.  Did you ever find the other wives given ds5535 from Pakistan?  I did a quick search and found https://www.visajourney.com/profile/270367-rafiq-akhtar/content/page/3/?type=forums_topic_post  

 

I was keeping a spreadsheet but have not updated it quite sometime but here are some Pakistan VJ members given ds5535 unfortunately many disappear and we don't get to hear their end result.

ZKSR CR1 17-Mar     I been in 40 countries. I have couple of visas  
Rosepetal3333 Cr1 18-Sep x 7 My husband was given a ds5535 and was in AP for 7.5 months. His visa got issued on its own, they asked for new medical. I was on the verge of suing the embassy but ended up not doing it because the visa got issued on its own. My advice would be to wait like 2 months then think about suing the embassy with a writ of mandamus. Good luck.

Maybe you could post google sheet. I’m so free nowadays that I can research more & more. Mind is losing it everyday!
