K1 Visa (6 mo) will expire before she travels to US

My fiancé’s approved K1 is about to expire before she can travel to the US. Due to a death in the family and complications resulting from that. Is there anything we can do to extend her 6 month visa? I am currently with her here in the Philippines and we need more time to prepare for her and my departure.

Maybe.  Get a hold of the IV unit of the embassy and see what they say.  I am sure you will need to demonstrate a valid reason.   If they agree you will need a  new medical as the medical only had a 6 month shelf life.  They may ask for other updates as well

Contact the consulate and explain the situation.  They have the ability to extend it.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I thought the medical was good for a year, is it different now?

I have not read anywhere that the K1 visa can be extended ONCE GRANTED.  The I-129F can be extended (due to scheduling, etc) but once the K1 hits the passport it a done deal.

 

Visa are usually once and done.. they are not extended, but rather renewed (with a new one and that means starting from scratch).

"My Petition Expired – Can It Be Extended?

 

The I-129F petition is valid for four months from the date of approval by USCIS. A consular officer can extend the validity of the petition if it expires before visa processing is completed."

 

 

With your visa, you can apply for a single admission at a U.S. port-of-entry within the validity of the visa, which will be a maximum of 6 months from the date of issuance

Validty is 6 months from the date of the Visa medical not the issuance of the actual visa

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

K1 visa's are not extended.   I-129F in process can be (as they are only 'good' for 4 months one at the embassy/consulate).

 

I even gave the source material.  I never knew USCIS/Stae Dept was so wrong on so many things.

It could be re-validated/reissued per https://www.siam-legal.com/us-visa/reissuance-of-a-k-1-visa-for-thailand/

A visa can be re-issued at the CO's discretion. A new petition is not necessary. A new medical should be necessary since the old one would be expired by then.

In emergency situations we have seen examples of K-1 visa being reissued with a new expiration date. Whilst they are not ordinarily re-issued/extended and they are designed as a one-shot deal, there are always exceptions for emergencies.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

what happens if your petition expires before your interview date? Do you have to get it extended or does the consular office recognized it and do it for you?
