Wrong

it depends on the relationship to the petitioner and manner of initial entry - if enter legally and are immediate relative of USC, then overstay, illegal work etc all get forgiven on adjustment 

huge loophole in immigration law that many take advantage of

You may not be, but pakistani (and Indian, hence the S.Asian) mothers tend to help around with cooking and household chores around childbirth. While those are normal grandparent dotes, it's something on a tourist visa that could be seen as an issue. 

 

Do you have a plan B? In the event your mother's visa is denied, do you have your mother in law around in the US?

Same is true for my wife and I. She would be happier in her home country. As someone born in the US and having lived my entire life here, I'm finishing out my career here and then we'll make a decision on where to live next in the world.

My mother and father in law are in immigration process. Their I 130 is under process for approval.

Ok.. well, no matter what everyone here says, no one has any say in your mother's visa adjudication. She has to apply by filing out the ds160, state facts as they are, and then interview either in KHI or ISL. The rest would be up to the visa officers.

They are free to apply, but with a pending i130, unlikely to be approved. Tourist visa requires non-immigrant intent, and with an immigrant petition in the pipeline, the odds are slim. But they could try if they have a spare Rs30,000.

Yes, they can apply.......but successfully obtaining one is another story all together....is it possible? Yes........is it likely? No....

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That’s true, unfortunately and that’s what makes it so hard for so many of us ‘good’ guys!  🙂

So after all this, you tell us she is in immigration process?  Why not be honest from the beginning?

Not the mom. OPs inlaws have a pending i130 through USC son (OP's hubby).

There's a question on the DS160 regarding if an immigrant visa has been filed on behalf of the applicant, she should answer that with a YES.

Incorrect

The applicant in this case, OP's mom, does not have a pending immigrant petition. OP is an LPR and cannot petition a parent.
