Random question.

When you finally have your i485 interview, do they ‘back date’ it? As in will it show the day you filed for the AOS as your first day as a resident?

Under the K1 you can use the 3 year rule to apply for N400. Just wondered what date they are working with.

I believe it is the date on the Conditional Permanent Resident Green card. The date of approval of I-485.

Just about had a heart attack today. Saw in the daily USPS informed digest email that a letter from USCIS was coming today. Checked the mail 5 mins ago and saw a letter on red paper (not a color I associate with good news). Open it up and it basically says we didn't send the medical evaluation form when we filed the 485 back in April. With AOS filings in Charlotte now taking upwards of 2 years, we decided to not do that until we got the interview scheduled so the form didn't expire (based on the old 1 year rule, now extended to 2). The letter caught me off guard though. Has anyone else gotten something similar?

Haha, same thing happened to us. Ours was purple though which is strange. But it was the same courtesy letter. We are also waiting until the interview is scheduled to do the medical.

Wonder how long the expedited request will take to be assigned ?! I don't want to rush things out ,but any experience with that ? website when I sign in for the account says

To be assigned should be within 5 business days from when you called. Then most people seem have the card in 3-5 weeks. Unless you’re me. Then you wait more than 2 months and still have no updates.

Thanks for the clarification.

It’s a shame it’s not from filing date. At this rate I expect I will have been here 5 years by the time I can file my N400! 😂

Hi, our NOA1 was April 10 and we had our biometrics on July 24th after calling USCUS multiple times and then going through the congresswoman. And the biometrics was ONLY for the EAD and not the AOS. They say the biometrics for AOS (code 3) are only valid for 15 months since they go to the FBI database for background checks, and since the AOS timeline for NY is 15 to 32 months therefore they will only take those biometrics once they know you are in the 'safe window'.

For EAD and AP it doesn't matter. For your AOS interview, what matters is your field office (see the first page of the thread for how to find yours), not your state; San Francisco is a lot slower than San Diego.

I hope everyone is doing well and holding up. I thought I would give an update on our case.

Last month we learned that my mother in law is going to have surgery, so wifey needed to go. We consulted with the lawyer and he said to call USCIS and schedule an InfoPass to apply for an emergency AP.

07/18/19 - We called and the agent said that we can't apply for an emergency AP if we have an application pending, so he can apply for expediting which he did for us. I consulted with the attorney and he said to call back and tell them we want an emergency one, not an AP. The second agent took down all the info and wrote some notes and told us an officer would call us within 48 hours.

07/19/19 - An officer called and chatted with us about the emergency then scheduled us for August 2nd to go the local USCIS office and submit an application for emergency AP.

08/02/19 - Our appointment was at 1PM and we arrived at 12. We had all the paperwork ready (New I-131 Application, Wife's birth certificate, Medical note about mother in law's condition, two passport photos) and were seen by an officer in about 10 mins. He said everything looks good, but, the medical note needs to state when the surgery date is and that my wife will be her mom's caretaker. He said we had two hours to get it or we have to get another appt. I made calls oversees and got them to track down the doctor and he sent us a new one in email. I printed it and presented to him and he had the AP ready and signed.

08/03/19 - Received a Text/Email update that the EAD card is being produced. I am guessing the AP might have been holding back the EAD.

I hope this helps. If any has questions, please let me know.

For my EAD expedite they sent the fax instructions by regular mail so I’d assume it is also possible in your case.
