what is everyone answering to the following question?

5. If you check “Legal Alien Not Allowed to Work” or “Other,” you must provide a document from a U.S. Federal, State, or local government agency that explains why you need a Social Security number and that you meet all the requirements for the government benefit. NOTE: Most agencies do not require that you have a Social Security number. Contact us to see if your reason qualifies for a Social Security number.

That has nothing to do with someone who arrives on a K-1, as a K-1 is a "legal alien allowed to work".

Go to https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530

 

Look  for the table with all the visa types. 

 

Look for the visa type that says K-1. 

 

It says “Legal alien allowed to work”

 

Print this form and have it handy if the SSA clerk denies your application.  

 

Now you are probably wondering how that is possible since in fact, a K-1 is not allowed to work (unless the k-1 has an EAD).  I’m sure someone here can give you a tortured legal explanation.  

 

All i I can say is that we answered allowed to work on the form and we got the SS card. 

 

I wish visajourney had a sample SS-5.

I have a question. I am a foreign fiancee who came on K1 visa, got married, gathered all documents and applied for AOS, AP, EAD at once and marked the option for getting SSN along with the process ( saying it has never been issued to me before, which is true). Now I found out that I'll have to wait 3-4 months for EAD and only then will receive SSN after.


Can I go to SSA office, request SSN and use that during the waiting period (for bank, insurance, rent etc.) ? Won't it negatively affect my EAD petition saying I didn't get SSN issued? Should I somehow update USCIS about this fact when I'll get the SSN issued outside of EAD process ?

You can try going to the SSA office. I suspect they will tell you that you need to wait for the EAD. If you luck out, and you end up with two SSNs, you can sort it out later with the SS office.

 

I think though that you are looking at getting an ITIN if you want a bank account. As for rent, even if you had an SSN, it would be useless because the credit bureaus won't have you in their systems yet.

 

It doesn't help you at all, but this is a reminder to people who still haven't entered the using on a K-1: there is reason why visajourney tells you to apply for your SSN well before you get married, marry, and then apply for your drivers license / state ID once you have an SSN and marriage certificate. Do things out of order or too late, and you will be without an SSN and state ID / DL for a long time, even if you are legally entitled to these things.

Exactly. So don't check "Legal Alien Not Allowed to Work" or "Other".

 

K-1s check "allowed to work", even if they aren't actually allowed to work.

Not a problem. At the time you submitted the I-765 you didn't have a SSN; that is what matters.

No need. When the EAD is approved they will forward your info to SSA and odds are they'll send out a SS card with the same SSN (since your date of birth, etc is the same).

You can try. If they issue it, it'll be with the name on your K-1 visa. Try it ASAP since April 5th (14 days before your I-94 expiration date) is a month away. Also, answer "No" for question 11 on the SS-5: https://www.ssa.gov/forms/ss-5.pdf
