Why aren't people applying for K3 to shorten the separation time between husband and wife?

Pros? Cons?

Filing for the I-129f petition for the K3 requires filing the I-130 for the CR-1.  Once the I-130 is approved, the I-129f is administratively closed.  Very few people will get a K3.

Because the K3 is pretty much obsolete. It will be converted over to a CR/IR1 process. There were less than 50 given out worldwide last year.

I applied for k3 only because I was doing the paperwork on my own (an attorney will charge a ridicules amount of money).  I figured it was worth a shot.   A few days before I received the i130 approval I received a notice that the K3 was administratively closed as the beneficiary was accepting other means (meaning my I130 was approved and it was no longer needed).

 

So in short if you are filing on your own and want to give it a shot go ahead (no extra fees needed) but I have yet to see on get processed since my time on VJ so some may feel its a waste of time.

From what Ive read, petitioner must submit both I-130 and I-129f at the same time. That's indication to the USCIS that your spouse intends to file for K3 (after your I-130/I-129f are approved and about to be sent o the US consulate). So I don't get why would they close I-29f!

Thanks m8! But there's an additional fee of $460 since they ask you to file both the I-130 + I-129f simultaneously.

You file after receiving your Noa1 it is closed because the I130 is processed first.  Because the I130 are processed faster it closed the I129f.

As the others have said...few approved. In 2018 there have been 4 (2 Mexico, 1 Honduras, 1 Netherlands) vs 10,000+ CR1

Sometimes being apart for a while is good for the soul.  Other than that, the K3 is essentially obsolete.

My understanding is the I130 still processes.  You are able to come to USA and work while you wait for the completion of the I130.  I could be wrong as I didn't get that far but that was what I understood when I filed it.

Applying for a K-3 is generally a waste of money and time. 

 

You have a greater chance of winning the lottery twice than actually receiving a K-3.
