December 2018 I-129F (K1) Filers

You can submit the actually filing 1040 with all schedules so yes all 90 pages. But, with that many pages, you can also go to the IRS website and request a copy of the transcript which is no more than 3 pages tops. Same day printing and FREE. At one time it was reported the site was down do to the shutdown, but recently as a week ago people are reporting that it is open for business again. Here is the link.

Timeline

What sorts of things could create a hold up when the USCIS are conducting background checks? I don't have a criminal record (beneficiary from UK) but my fiancee in the US does for just a couple of things like carrying an unlicensed firearm and two road accidents. Will these things slow down the process?

When I visited the US for the first and only time, I stayed for 84 days on the visa waiver which allowed for me to stay for 90 days. When I tried to get back into the US they refused me entry and of course my visa waiver became invalid (September 2018). They told me to apply for a visa instead. 

Whenever the border agent asked me if my (now fiancee) was my boyfriend I said no. Whether or not he really was or not, I stuck to my story of him not being my boyfriend, as did he when they questioned him. 

I think that they thought that the second time I tried to go to the US, I had intentions of staying, which of course was a huge red flag for them. I had minimal connections to the UK (no job etc.) and I suppose they thought: if this man isn't your boyfriend, why are you staying in hotels with him and travelling around together?

Another issue is: On my 1st attempt to visit (which was successful) I told them a lie about how me and my 'friend' (now fiancee) had met, I actually begged them to give me a chance to tell the truth and they asked me again and I told them the whole truth. This time they let me into the US.

On my 2nd attempt, they told me that I had 'lied' and they 'don't forget when I lie to them', but the border agent never told me what it was I lied about. On my first and only trip to the US I told the border agent that I would probably be catching an earlier flight than the one that I had booked back to the UK because I had my graduation I might like to attend. During my stay in the US I changed my mind and didn't go to my graduation. 

 

With all this having happened, will this be a problem at the Consulate interview or even the earlier USCIS stage? 

Will I be asked questions about any of it and whether I told lies?

It's really hard predicting the things that hold up an application during background checks like mine for instance no criminal records of ANY kind no nothing. It's like it's a hit and miss but I would say common first names and last names don't help the process to be any quicker but then again some people breeze right through others linger on for months. Was your fiancee convicted of any of those incidents was he arrested for any of them? If so hopefully he answered yes to the question on the I-129F dealing with arrests. Also if he was arrested and charged you'll need the court disposition to each incident and hopefully you submitted those already if this applies to you.

I think that our last names aren't too common. He says that he was never charged for any of the incidents, never arrested etc. The charges for having an unlicensed firearm was dropped. The only time he was arrested was for road traffic-related incidents and they weren't alcohol or drug related, on the form it asks for a yes if these road traffic incidents are drug or alcohol related. All seems fine for now. :)

Here is the most telling information that will answer your inquiry.

 

As part of its benefits adjudication process and as required by law, the United States Citizenship and Immigration Services (USCIS) conducts background checks on petitioners and applicants who seek certain immigration benefits. These background checks consist of four separate checks against systems within Department of Justice (DOJ), Federal Bureau of Investigation (FBI), and the Department of Homeland Security (DHS). In order to facilitate the collection and transmission of information necessary to complete background check processes, USCIS maintains five information technology electronic systems: the Fingerprint Masthead Notification System (FMNS), the Customer Identity Capture System (CICS), the FD-258 Tracking System - Mainframe (FD-258 MF), the Benefits Biometrics Support System (BBSS), and the Interagency Border Inspection System (IBIS) Manifest. USCIS is conducting this privacy impact assessment (PIA) because FMNS, CICS, FD-258 MF, BBSS, and IBIS Manifest collect, use, and share personally identifiable information (PII). This PIA replaces the previously published USCIS PIA for the "Background Check Service (BCS)" which describes planned background check-related systems that were never implemented. Upon publication of this PIA, the BCS PIA will be retired.

If the information is in your background (in your immigration file) it could influence their decision. We rarely see such a "lite" posturing at a check point (POE) influence but it could. Immigration DOES NOT LIKE IT WHEN YOU LIE. I can only say we will have to wait and see. If you have learned anything from this I hope it is that you NEED to tell the TRUTH to immigration. They are pretty smart and have been around the block a few more times then you. Get caught in a lie at this stage and it is DENIAL and banning for many years.

Timeline

Does anyone know where to find the reasons why USCIS denied a K1 visa in a legal format? I'm looking for the document with all of the legal complicated information about why they refuse a visa.
