that's exactly the case i'm checking the second box because i'm sponsoring her and her child. how's is that sound to you

i have NEVER felled this non smart in my life this affidavit is like telling me having a daughter is a fault. in my case if i check the two box there meaning i'm sponsoring her and her daughter then a bit forward it ask to put one for your husband and its putting my household to 4 but we're only 3. so if i decided to do another affidavit for the daughter should i check no for the first box or what should i do.

Hello,

See below a model of a I-864 for your situation. I found it online, but I can't remember where. Good luck!

Like I said before, I do not have children, so I do apologize for suggesting a second affidavit of support for the minor child. Apparently, you only do that if the child did not arrive with your spouse. The instructions of the I-864 clarify that on page 5: "Family Members Immigrating Within Six Months. The immigrant you are sponsoring (the principal immigrant) may bring a spouse and/or children to the United States. If the spouse and/or children will travel with the principal immigrant, or within six months of the principal immigrant’s entry into the United States and you are sponsoring them, you should list the names and other requested information in the spaces provided in Item Number 2. If any dependents are not immigrating, will immigrate more than six months after the principal immigrant arrives in the United States, or you are not sponsoring them, then do not list their names here. A separate Form I-864 is required for them when
they apply for their immigrant visas."

thx so much for this i have finally decided to do it that way and if its not accepted they'll return it to me. so i filled the affidavit exactly like the sample you sent. and i'll make a copy of that and put in the the minor daughter paperwork. that's the only thing she need because we're nor filling the EAD nor AP FOR HER. SHE'S JUST ADJUSTING. thx again

Morning everyone....just woke up and saw that USCIS has cashed/deposited our check which means they've accepted our filing. I'm sure I'll receive our text and email sometime today and NOA1 in the next few days. So it looks like it's taking a week from filing date for the to accept petitions.

ROC Filing:

4/21/2021 - Sent ROC Package via FedEx

4/22/2021 - FedEx package delivered and signed

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken

illegal?

out of status?

As long as you filed your AOS paperwork before your I-94 expires you are NOT out of status. Your status is pending because you're waiting to adjust. If you file after your I-94 expires, you are out of status.
