My husband had the CR1 spousal visa interview in Jan 2019 and was told congratulations and welcome to the US here are the forms to register to pick up you visa and to pay your immigration fee form. 5 days later we get an email from the embassy saying that they did a final review of our case and had to be put into administrative processing and my husband should pick up his passport (which he did with no visa inside 😔). They didn't ask for any additional information. We are so worried because we have no clue what's going on. We have sent several emails with no response. This has been the most painful experience ever. Even our lawyer has no clue what's going on. Pls help!!!

  6. Hey! I'm writing this to get your guys opinions on my advance parole situation - and sorry if this isn't in the right place, I'm new to this forum. My fiancé's visa was approved and he's coming to the USA from Sweden this week (8 months to the day from when we sent the I-129F), we're getting legally married at the NYC courthouse 3/1. We're having a big wedding in Iceland in August 2019 - before you guys comment, we're not getting legally married in Iceland, just ceremonially, and we're doing it because we weren't sure about the timing with the visa and wanted to have a big party with all of our friends from NYC and Sweden 🤷‍♀️ Anyway, August 3 is almost exactly 5 months from our legal wedding in NYC. We had assumed that we would be getting the K1 visa much earlier than 8 months, and also assumed that advance parole would take 2-3 months. It seems that advance parole is taking much longer than that, with an average of 5-6 months. I know it's highly unlikely we'd get approved for emergency advance parole, because a wedding is not an emergency. We've already paid for the entire wedding in full, so rescheduling it will definitely be a financial burden, but we obviously can't have a wedding without the groom. Is there anything we can do to make sure we get his advance parole before 5 months, or do we eat our money and reschedule the whole wedding to a date we know will be 100% okay? Insane that it could take up to 16 months with no RFEs and everything done correctly.... Anyway, would be eternally grateful for any advice and we're quite unsure of what to do. Thank you in advance!

  8. I'm sharing my personal AOS experience of trying this approach (without a lawyer). If you see my timeline, I'm in the very early stages of the AOS process. I'll provide future updates of my AOS progress. As you can read for yourself in this recent cheat sheet for immigration lawyers, two different circuit courts have found that when USCIS grants TPS it counts as an “admission” for purposes of AOS. The two cases are Flores v. USCIS, 718 F.3d 548 (6th Cir. 2013) and Ramirez v. Brown, 852 F.3d 954 (9th Cir. 2017). But you can only use this approach if you reside in the Sixth Circuit (Kentucky, Michigan, Ohio, and Tennessee) or the Ninth Circuit (Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington (state)). Regular AOS applicants usually submit a copy of their I-94 as proof of admission, but I provided a copy of the 20 page Ramirez v. Brown decision (because I reside in the Ninth Circuit). I concurrently filed the I-130 (by my USC 21 year old son), AOS, EAD, and AP. I'll post as replies below my cover letters for each application (without personal info). Feel free to ask any questions if you are in the same situation.

Hey everyone I hope you are doing great!, Well, I had my K1 interview yesterday in the US Embassy Algiers,Algeria, the whole process was smooth, not too many applicants, the staff was very friendly, the embassy officer asked me usual question : What is your fiancé's name? How long have you been together? How did you meet? Where did you meet in person? How many days you spent together and where? How did your relationship became romantic? What do you love about him? What does he do for living? Can you list his family memebers and where do they live? Does he live alone? And then he told me "Congratulations! Your visa has been approved" I was very happy and felt a mountain was off of my back, then he told me i will be back with you, he went for about 10 mins, when he came back he gave me a a form to fill that contains my informations such us Name Address Siblings and their date of birth Employers (name, address and employement date) My emails My social media accounts Told me to fill it and give it back to him After i did, he gave me a white slip (221g) and told me my case needs some administrative processing and he gave me back my passport and told me we will email you when we are done and ask you to send us your passport, I left the embassy heart broken, waiting for (god's know how long) they email me... What made me feel sad is because they gave me back my passport. And i am more confused because he approved my application at first, so can you please tell me if you know cases like this or what do you think about it?
  10. Today at the airport, my EAD card was lost while checking into my flight to Paris. I have a flight in the morning from Paris to the US and no longer have my EAD card. After multiple attempts to find it and file a police report I haven't been able to locate it. I have photocopies of my ead card, my advance parole approval notice, pending AOS receipt notice, marriage license and original K-1 visa on me. What can I do? Can I still board my plane to the US and what are my options if not? My wife is in the US and can go to our local uscis office or anything that can help. Anyone have any ideas how to solve this??
  11. Hi everyone, I hope you're all having a good Monday. I have a quick question regarding AP with an EAD. My husband rec'd his EAD card this past weekend. We did not file a I-131 with our package as there was no upcoming travel needs for him for the foreseeable future. In light of that, and some Google image searches I did in our downtime, I fully anticipated seeing language on the EAD card indicating that the card was not able to be used for advanced parole. However, his card as printed says that we can use it for advance parole. To me, this seems weird. Any thoughts? We wondered if there was a possibility that this occurred due to the fact that he's Canadian. We have no plans for him to travel any time soon (domestically or internationally), so it's not a big issue. However, if the event arose, it would be good to know if he COULD travel while the I-485 is still pending. Thanks for any input you all have!
  12. Hey Guys, My wife just got her EAD card with AP permission after coming to the USA on a K-1 visa. She is from Algeria, which is part of MENA. I am scared that under this administration she will be denied re-entry. I am torn apart on what to do. She misses her family so much and I want her to travel to Algeria but I don't want to risk losing her and undergoing the immigration process again. I need some input. My family is deathly afraid that she won't come back and it's really giving me and her second thoughts on her visiting her family back home. Is my fear and concern completely blown out of proportion? What should we do? Thanks for all your help.

Hello Everyone, I got a call from Islamabad embassy yesterday inquiring about the contact numbers I use and my email address and places I have worked. the officer was a Paki guy and was talking in Urdu and was very strict in Tone. this is the first call I have received from the embassy after my interview, my interview was on 1st June 2016. Does this means they are about to speed up my case or is it just a normal process for the Visa Admin Processing's? I read most of the people have been visited by the field agents who were inquiring about them. BTW, my visa case is I-730, follow to join case. Everyone please kindly share your views

  15. Hi all, I am a K1 VISA beneficiary, I am now married, and I'm finally able to sit down and start the AoS application. I have read the guide on here, as well as the instructions on the I-485, I-131, and the I-765. In the beginning I thought I only had to file these three forms, and file them together. (with all of my evidence of course) I'm not always the best at filtering through the correct information but I do my best, but somehow I've now ended up with 7 different forms, and I was just wanting to check that I had it right, and that they were all necessary. My queries are with regards to the following forms: I-130 (Is this to be filed separately, or with the the I-485, I-131, and the I-765) I-130a (as above) I-693 (Does this go with the I-485 as "evidence", or does this get given at the interview?) My paranoia is usually fueled by how old the original posts are, and what updates are applicable etc. I'm almost confident I'm on the right path, I was just hoping for further clarification from anyone who has submitted these forms recently, and how the journey has been so far. Thanks all in advance.

Hi guys, My fiance and I applied for a K1 visa, and I went to the CO for an interview a month ago while he put me on "administrative processing", asking for my resume (i guess im under TAL, since I work in a technical field). 2 days ago it changed to "READY", with this statement under- "Your case is open and ready for your interview, fingerprints, and required documents. If you have already had your interview, please check your status after two business days. If no interview was required, please check back in two business days for the status of your application." 2 more things happened- 1. "Case Created" was changed to the same date as 2 days ago (it originally opened on January 2017) 2. It changed from "IMMIGRANT VISA APPLICATION" to "NONIMMIGRANT VISA APPLICATION" Today (48h after ==2 business days) it changed to "Application Received", without a change to "Case Last Updated" (remained 2 days ago). What does "Application Received" means? there's nothing on google about it. Thank you all in advance! Regards, Dave
  17. Hi VJ members, I had an interview today for CR1 in Islamabad. Everything was very smooth the interview was hardly 5 minutes and at the end, that lady gave me this 1-page white form, initially I was not sure that what this form is and I didn't even read it at the counter. I asked her to what to do with this form and she said just keep it with yourself and the form title is Immigrant Visa Section (Modernized Immigrant Visas) and it says you visa has been refused under the provision of the immigration and nationality act and also section 221g (your visa application is refused for AP) is tick marked. Under this, there is General Requirements and Evidence of economic solvency and they both are highlighted with yellow ink. Also about the passport, she said that you will get it after 1 month. My wife was also there with me and we went together to the counter but the lady asked her to stay there in the waiting area. Now I don't know what to do or what to upload and the status of my case is not changed on CEAC website. 1 more thing that initially we submitted the birth certificate from the hospital with my SSC certificate to USCIS and then NVC wasn't accepting it then we uploaded the FRC from Nadra and now on interview we took the original birth certificate from Union Council and we also gave them FRC and the hospital issued birth certificate. Please share your thoughts. Thanks alot!
  18. Hey everyone ~ My fiance has been on AP at the US embassy in Colombo, Sri Lanka since 4 September 2018 and our status on the CEAC site still has not changed from "Ready." We've emailed the embassy once a month and have gotten pretty generic responses. Our latest inquiry yielded this response ... "Our office is waiting for certain clearances to further process your case. We understand your difficulty because of the delay in the processing. The timing for these clearances are generally based on the history of the case. Our office will contact you as soon as your case gets the clearance." My fiance was born in Dubai, UAE and I'm aware that AP usually takes longer if the beneficiary is from a MENA country, so we're not really surprised. Has anyone else's status been stuck on Ready? Also, does anyone else know what the "certain clearances" could be? Any advice appreciated! -Anna
  19. Hi Guys! I filed for AOS/EAD/AP based on a K1 visa on Feb 2018 shortly after I got married. I received my EAD/AP combo card on July 2018 and it is valid until July 2019 (1 year). Meanwhile, since I reside in NYC, the AOS(I-485) takes much much longer than expected. I'm waiting for them to schedule an interview since September 2018 ("Case is Ready to Be Scheduled for An Interview"). USCIS is saying it takes 15-31.5 (AOS) months for NYC - https://egov.uscis.gov/processing-times/ It looks like my current EAD/AP will expire (July 2019) before I'll receive my green card. What are my options? - Is it true that I can submit for a renewal up to 6 months before it expires? - Will they waiver the EAD/AP fee since it's based on a AOS? - Will it be quicker this time since it's a renewal? (It took me 5.5 months to get my current combo card) Thank you all so much, this forum kicks ###! -David

Hi All, After 9 months of waiting and wondering, we thought we finally reached the finish line with our K1 visa process, to our complete shock, we were put on AP, despite having everything that was asked of us, all the required documents, tons of pages of texts, viber logs, facebook messenger logs, whatsapp logs, pictures, anything and everything. Most of those put on AP out of Cairo have been on AP for months with no end in sight. I dont know what we should do at this point? Anyone been in this situation?

  23. Does anyone here ever experienced leaving the Philippines with advance parole? I have a pending green card case and I am planning on going to the Philippines in March. I was wondering if I have to go to Commission of Filipinos Overseas to get registered. I didn’t go to Commission of Filipinos Overseas before because I was just an international student, but I was wondering if I have to now that I am married to a Filipino-American.
  24. Hello people, Thank you in advance for your responses. I came to America in June 2016 on my tourist visa which expired after 6 months in Dec 2016, I married my husband in November 2016 but we did not file concurrent AOS until April 2017, the forms were initially rejected due to them being expired so once we sent everything back it was May 2017 and they were received with no problems. I have since been granted my combo card and would really like to travel back home for maybe two weeks to help assist with my dad. I am very nervous as I did overstay I think a little over 130 days seeing that my i94 expired in dec 2016 and I didn't file and have my forms received until May 2017. Kindly advise if this is a good idea, I haven't been home in about a year and my brother has been taking care of my father and could really use some relief. What can I possibly be faced with when it's time to return to the US to my husband. I hope to buy a one way ticket and then buy another one way ticket when I am returning, will this be another issue?   25. Hello, I feel that there is no 1 thread to share experience and timelines for AP. It's a frustrating time so it might be helpful to share timelines and experiences to get a feel. ----------------- Our case: Interview (10/9/2018) went very well but was given a white 221g for missing documents - proof of domicile and I864A Was asked to send my passport with the missing papers. We provided all missing documents 2 days after and sent the passport as well. The passport was returned to me few days later. We have been in AP since. We were planning on being in the US by now but this is not happening now, and it's very frustrating since I am pregnant and wanted to buy a house and get it ready before the baby is born! What has been your experience so far?
