Can USCIS tier 2 provide inaccurate or wrong information?

It's been 85 days since RFE was received by USCIS asking for some financial documents regarding income requirements.

Can someone share some thoughts and their experiences?

 

So were you able to provide exactly what were requested? Might the USCIS be confused about what were sent back? Fingers crossed for you!

Ya my lawyer said he provided it, he didn't even send a copy of his response to me. Hope he didn't screw things up, Allan S loly, CA my lawyer

Either:

1) The officer meant that the case may be denied if the RFE was inadequite, or

2) The online case tracker is not updated and a denial or NOID was issued, in which case it will arrive in the mail. They can't disclose the contents via phone.

 

My money would be on #1 if the correct information was sent back, but I'm not a betting man.

As an answer to your first question - yes Tier 2 happens to hand out the wrong info from time to time. Usually, Tier 2 knows nothing, Tier 1 knows even less. That just USCIS for you.

I agree 100% with NikLR. VJ knows the USCIS customer service line as the misinformation line. 

 

They are not reliable, nor is the online case tracker all the time.

Everytime I talk to them they say that they dont know anything and that only the officers knows what actually is going to happen. 

I can tell you the wildest stories about Tier 2 officers claiming towards me that they "don't know more about my case than what I can see online" and next time I called again and spoke to another Tier 2  all of a sudden he be able to give me all kinds of info about what's going on. Example: I had to reschedule my Greencard interview bc me and my husband were going to be out of the country. I asked it to be rescheduled and eventually saw online that a decision regarding my AOS reschedule inquiry was done and a decision was soon going to be mailed. since It takes forever to receive these letters I called the hotline, asked to be transferred to a tier 2 and was told that he can't see what the decision was (approved or denied). I hung up and called again and this time the tier 2 could read the entire letter to me that I was going to receive! I have the feeling that some tier 2 officers are more motivated than others to help. Some claim they don't know anything while others can give you all kinds of details...

As others have already stated, Tier 2 officers often give out inaccurate answers. If I were you I would call again and speak to another tier 2 officer. That's what I always do and they tend to give you different answers. 

Also, I heard great stuff about your lawyer! He seems to be pretty popular among VJ members...

My guess is that the Tier 2 officer (who may be able to access more information than we can see but often don't bother) was able to see that something had been mailed to you. Anything after that was just listing off things that USCIS might mail to you.

thanks for all your responses guys, I spoke to a different tier 2 today, she said that my case was recommended for denial by the adjudicator and the supervisor still needs to approve the denial for my I485 and it's not denied yet. I still may have a chance if the supervisor doesn't approve the denial. I was also told to write a letter to NBC explaining hardship and resubmit RFE before my petition gets approved for denial by the supervisor. This was the suggestion from tier 2, any suggestions from you all?

Thanks for the great information about the possibility of resubmitting the RFE response: that would be a big time and money saver!!!

But I dont understand why it would be denied? What have you done wrong? I hope youre feeling ok!

I don't know neither, just hope for the best. I have an EAD thru OPT and may be able to extend it for 2 years. My wife- the citizen is pregnant so she will have to deal with everything herself if they deny my case. Hope they don't deny it.
