You can look for a job, but you cannot work until after your marriage, and you file and receive your EAP.

You cannot travel out of the US until after your marriage, and you file and receive your AP.

The last I looked it was taking 4 months from filing to receive AOS/EAP/AP.

I don't know what the status of the country will be next week - if I can fly into SaoPaulo  or have gasoline and clear roads to travel.  Right now - there is nothing moving and no food, water or gasoline 

in the stores.  I cant believe this is the next hurdle to overcome - getting into Brasil and out again with my bride.  I have to make a decision by beginning of next week to push the flights back if the situation

does not resolve.

Anyone else from Brasil trying to depart in the next two weeks?

I believe things are calming down now. You shouldn’t have a problem. Congratulations!

I have completed the DS-160 and trying to pay for the visa online but I am been told that I must await package 3 before I can proceed to set up the medical. This process truly is adding to my stress levels but so worth it

Depending on your embassy (I see you're in Jamaica) you can proceed without getting a Packet 3. In other embassies, you need to wait until you actually receive it, either by e-mail (most common) or mail (not very common).  But it would be helpful to see if other people going through the K-1 process from Jamaica were able to set up the medical without having Packet 3.

I'm getting conflicting information as the help line is telling me that I need the package 3 when I'm seeing that a few posters have continued the process without it.

I'd say it can't hurt to try...the worst that can happen is that you have to wait for Packet 3

Thanks, Janay.  I made it into BRASIL, hahaha. (for a while I was really worried) - a week after the 10 day truckers strike.

We flew out on the 10th and entered through Atlanta.  Waited 1.5 hours in customs line, missed connection to Charlotte and were the

very last people to go to the booth.  (Very poorly staffed ).  We were processed in less than 10-minutes...Customs Officer asked nothing....was as easy as could be after the long wait in line.

 

We were married on the 18th in the Charlotte Courthouse.  Life is good!  Best to all

Hello Everyone!

I hope that all is well with everyone! 

 

I need some help, I feel as though my fiancé and I have been reading in circles on VJ, Uscis and other websites.

 

my p.o.e was June 2, we are not married yet. 

 

My question is about filling I-765 and I-485.

Like most of you (I’m guessing) want to work as soon as possible. 

 

I was was about to file both I-765 and I-485.  If I’m approved to work on 1-765, and I get a job and now the 90 days are up, While the I-485 is still pending, can I continue to work? 

 

 

I just need need someone to dumb down the whole process and explain easily what the next steps are😊

In the short term, what you should do is

  1. Get a Social Security Number if you don't already have one (you'll need one to work, and lots of forms you'll need or want to fill out later may not technically require one, but not having one will involve having to point out the letter of the law/regulations to get things done, so get one ASAP). Also, if you're planning on changing your name when you married, it's much simpler to get an SSN before you do.
  2. Get married
  3. Get several registered copies of your marriage certificate (you'll need them a lot for the remainder of this process, especially if you're changing your name)
  4. File for AOS (I-485) + EAD (I-765) + AP (I-131)

 

Although it's technically allowed, there's no point in filing the I-765 (EAD) before you're married because it will take more than 90 days to process and if you file before you're married it would only be valid until 90 days from POE.

 

You can't file for AOS (I-485) until you're married.

 

You probably should file for Advance Parole (I-131) at the same time as the other two because even if you have no plans to leave the US in the next year or so before AOS is complete right now, that could change, and it costs nothing extra to file the I-131 and I-765 at the same time as the I-485.

 

But yes, once EAD (the I-765) is approved, you can work while AOS (I-485) is still pending. In fact that's the only reason it exists; once AOS is approved and you have your 2-year green card, you can work whether you applied for EAD or not (and travel outside the US whether you applied for AP or not).

Just wanted to give a warning about the SSN. We applied 2 weeks after John arrived April and the number was just assigned (still waiting for the card in the mail in the next 2 weeks) So it’s took a while for the information to be in the system. Try waiting 3 weeks to avoid the 3 month wait :/

We were very lucky with the SSN card.  Her POE was on 6/8.  She applied for SSN on 6/12, and she received her SSN card in the mail on 6/25.

I got mine pretty quick aswell, however I can't change my name until I've gone through the AOS 🤔
