Hi everyone. My husband and I are going for the AOS interview this coming April 30. We are now on the process of preparing our documents. We reviewed each document and found out that my husband clicked Married filing separately for the tax return instead of married filing jointly. We are now worried that they might consider it as a red flag. 😣 Should we try to change it before we go for the interview? We only have less than 2 weeks left.

We also filed married filing separately since it was easier to do it that way. We're not even bringing our tax returns to our interview next week since I don't think that would be helpful for our case and we have other pieces of evidence that are much better.

Just as a reminder, they want to see your 2017 tax return for the affidavit of support, if not to prove the relationship, so I would take a copy of that if I were you :)

I already submitted my husband’s 2014-2016 tax returns with the i-864 in the application but it’s a good idea to bring the 2017 just in case. I make more than my husband anyway so it really shouldn’t matter.

Well, they just want to see the sponsor's last tax return for the Affidavit of support. I know someone that didn't think of that as something necessary to bring to the GC interview, so just leaving a reminder here for everyone :)

Yes, it does matter. He's your sponsor, they will want to see he makes enough.

I have the same issue. I already submitted affidavit of support with my application and his previous year tax return. It says in the interview letter to bring affidavit of support if not submitted which I already did submit. I’m gonna get his tax returns with me ( most recent one we filed seperatly) but I won’t show it  unless asked for it .

Yeah that's usually the recommendation. Take the most recent (especially if when you filed, the previous year was the most recent), and if asked, give it.

Hi guys

My husband came to the states on a K1 visa and we got married and filed for AOS ... we finished our fingerprinting on the 21st of feb 2018 and haven’t heard anything ever since ... both the websites say “fingerprinting fee received” that’s the last update on 30th Jan 2018 ... we have been waiting patiently but I just wanted to ask you guys if this was normal and does anyone have any idea what we should do.

We appreciate any input you guys could give us.

This wait seems pretty long.

thank you

Hello

Yes it is unfortunately normal, EAD/AP take about 3-5 months now and the interview is according to your local office, some wait up to 1 year for it. You can try to call or schedule an Infopass appointment but I doubt it will do anything because you are still within processing times.

You can also try contacting your senator/congressman or ombudsman and see if they can try to expedite your case on your behalf.

I am in a similar situation, no news or movement on my file since Feb 23rd we are getting close to 2 months now. All we can do is wait and track our cases online on the case tracker and DHS website until we are outside processing times.
