K1 RFE NEED HELP!!

Hey guys so I've been waiting since January and finally got an rfe Friday .. it just came in the mail today and it is asking for evidence of form I-130?  I never filed form I-130 I filed form I-129F so I am very confused at what they are asking me for .. this is exactly what the rfe says, if anyone has any knowledge please help. Thank you

I'd get your congressman or senator's immigration liaison involved at this point to 1. Sort out this RFE as you applied for I-129f and not I-130 and 2. Get you the real status of your case.

What exactly did you file? An I-129F + ...?

 

It sounds like you either filed an I-485 OR you checked K-3 on the I-129F. Or they simply goofed up.

It looks like they somehow believe you are applying for a K3 and not a K1.

People that are going to file for a K3 visa also use the i129f form. One of the requirements for them is that there is an underlying i-130. I understand that you filed i129f... did you check K3 on that form by mistake?

I don't believe so, and every time I have called they never mentioned it as a k3 app only K1 .. I do not have a copy of my i129f form.. is there anything I can do too figure out and or fix this if I did ?

I would just answer with a letter explaining why you don't have or need a pending i-130.

i sent everything in as a K1 visa as far as the letter of intent to marry within 90 days on a K1 visa and proof of meeting in the past 2 years, how we met .. none of these are needed for a k3 visa it's obvious I'm filing a K1.. it's very upsetting I've been waiting 8 months and this is what I get.. Idk what else I can do other than write the letter saying I filed for a K1 fiancé visa explaining myself.. which they should already know looking at my packet that I sent

you didn't make any copies of your information you sent in because your suppose to have separate copies for yourself and fiance in case things like this happen....but if you don't have copies then may have call them to see what happened

Yes I know, I spoke too tier 2 twice already they both have told me the same thing too respond with a letter explaining why I would not file a form I-130. Being that im not married and I filed for K1 Visa. I also spoke to my Congressman who I have already been in contact with and they said too fax over the RFE and they can get in touch and figure out why it would be sent and let them I would not need that form for the visa i am petitioning for.

Just wondering,  was it your State Congressman, or US Congressman that you contacted?  I just want to know just in case I need to go that route some time down the road.

Yea state, you would type your zip code in and they will tell you who your local congressman is.
