  1. Hello all, I did a voluntary departure 10 years ago. My daughter is in the USA married to her husband. Can I apply for a visitors visa? I have proof of strong ties to my country Brazil. My daughter can apply for a immigration visa for me but I do not want to live there. I would like to know if I should I apply or I am wasting my time or I need a waiver. Here is some more info about my case. March 2004, entered without inspection, never appeared in scheduled hearing, consequently July 2004 ordered removed. - October 2012 received Order of Supervision. - August 2013 Voluntary Departure. - Attempted tourist visa before 10 years, found ineligible under Section 212(a)(9)(B)(ii). It has now been 10 years since she has been out of United States, my questions are: 1. Does she need an I-212 waiver? Or can we submit a PD request to bypass the need for waiver, if that is the case? 2. Will she then be able to apply and possibly be approved for a tourist visa? Or will she only be eligible for an immigrant visa?
