My Journey So Far:

 

Oct. 2015 - Met Fiance Candidate online and skyped with her.

Jan 2016  - Flew to Manila to meet her and parents to move forward.

March 2016 - Filed Petition for Fiance Visa and K-1  - Receipt 3/3/2016

May 2016 - Update that File was moved to California for processing / backlog

June 2016 - Fingerprinting and Biometric Visit for Background Check - (I'm not perfect)

Sept 2016 - Update that File was Moved to Vermont for Dept of Homeland Security checks

Rest of 2016 - WAIT - WAIT and MORE WAIT

Jan 2017 - Missed my girl - Flew both of us to Viet Nam for A VACAY 

April 2017 - Notice of Intent ot Deny - USCIS got my Background information wrong

May 2017 - After paying for Court documents and registered mailings - sent correct information to USCIS - Receipt of Response 5/19/2017

This whole ordeal has been Grueling to say the least, but our relationship is strong enough to get through this.  So we wait - and probably another vacation in the works.

 

Here is the deal:

It's been over 15 months and USCIS was going to deny our petition based on incorrect facts about my background.  There are two scenarios in play here:

1.  They figure it out and Approve it because they have access to all information and got it wrong.

2.  They Deny just for Spite and then the following happens -  I sue them for Negligence on our petition for false information on our application.  (Remember that Fee you pay - well, that is for Service to get it RIGHT)

She will file a Tourist Visa to States to see family members here - and we will get married here anyhow, in which case USCIS is Bypassed.   

Until then we wait - but either way, LOVE CONQUERS ALL.

the service you refer to is determining if a visa should be granted, not if you pay money you get visa. so yes they can do the service you pay for and determine you don't deserve to get a visa. and getting a tourist visa after they denied a k1 vIsa is pretty much impossible  since she has immigrant intent through the visa and a fiance provides a very song reason to remain in the us.

 

 

by the way uscis does conquer love and quite often too. you are playing in thier court so you have to play by thier rules and they are the only ones who can give your fiance a visa. think of it this way you may be neo from the matrix all powerful and such by your stuck at that subway station and uscis is the train man.

What are these so called facts about your background? Sounds like you were trying to hide something.

 

As others have said, the tourist visa won't work. It's visa fraud and since you've already filed a petition for her she is considered an intending immigrant. That will make it very difficult for her to get a tourist visa. (it's already pretty difficult to get one if you're from the Philippines, especially if you're a single girl)

Just like that?  Single Filipina wanting to go to the US to marry and bypass USCIS.  Easy to get a tourist visa with a denied K1, right?

 

You need to do some research to learn how things work and how to do it right.  You are working off some very bad assumptions.

Do you have convictions that fall under the moral turpitude laws?  If so you may be denied.  I'm sorry this is happening to you but it sounds like you forgot or "neglected" to include some information.  You will never sue USCIS and your fiance will never get a tourist visa if she is from Philippines unless she owns SM Malls or has billion of pesos in the bank there.  Good luck.

OP, calm down. Want to sue USCIS? OK, good luck with that. And forget about visa forever I guess. They will deny it again and again.

 

Now, tourist visa is not an option. She won't get it because she's already in K-1 process. And she's from Philippines. Chances are extremely low.

 

Do not blame USCIS. That was your fault not submitting all documents on time. You paid your fee for the processing only, not for result. There's no fee for 100% result.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
