UK Bf denied entry to US/K-1 Info

Yeah MacUK, we also thought perhaps a fine or at the worst they would take away his visitor visa. Nothing as "overly extreme" as this (which is the wording both the Embassy in the US and UK used as well as my lawyer). 

 

We're hoping to avoid using a lawyer as the process is already costly and we are both fairly competent (I am also an ex-law student).

 

They were very clear that he isn't banned and would just need another visa to enter. So yes, while he is screwed in coming to the US ever again if something were to happen to us (though we are getting married because we believe in this for the long haul) hopefully that won't be an issue.

I truly hope your relationship prospers so this doesn't impact on his future.

 

I overstayed a LOT longer than 8 days and received a 10 year ban, that finished 5 years ago but I've been refused a tourist visa and have no reason to hope that I'll ever be approved for one. 

I'm a lot older now, and a tiny bit wiser, but a stupid mistake I made when I was your fiances age may well impact the rest of my life.

I accept that it's ultimately my fault I'm in this situation, I even accept and understand why the US aren't keen to trust me with a visa now.

But it hurts that I may never be able to take a vacation in the US with my new fiance.

But what's done is done and can't be changed, I just think if more people realised the consequences of overstaying then a lot more would think long and hard before even risking it.

If you'd known then what you do now I'm sure you would have got him on a flight no matter what.

Hindsight can be a #######.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

There's nothing overly extreme about this case unfortunately. It's in fact, completely normal operating procedure for this country, and his country even. But now you know, and at least have hope for going forward with a plan.

Same exact thing happened to my fiance last thanksgiving in Orlando, FL. Everything your fiance went through so did mine and it was a very degrading experience for him. And I was on the next flight out to him for moral support too!

 

He and I just FedEx our fiance petition packet yesterday and is out for delivery to USCIS as I typed this. 

 

No, this experience should have no effect on you guys applying for the K1. But just be honest and upfront with any and all questions that might come up regarding this if it comes up at all.

 

What they mean when they say he can come back on a proper visa is because they thought he would intentionally stay and immigrate on a visitor's visa. The customs agent told me on the phone that when I called to find out where he was and if he was okay, etc.

 

So you guys should be fine. Good luck on your journey!

He was refused entry primarily because he did not have a visa, quite a few other negatives, lucky he was not deported. They seem to have just bounced him.

Sorry you're incorrect. He had a visa, they invalided it on this stay. 

 

Anyway as I said a few days ago, what's done is done is done. *shrug*

Having a visa that is no longer valid is the same as not having a visa. The visa was actually voided immediately and automatically when he overstayed. They only wrote it on the actual visa when he went tried to go  through POE.

You're incorrect.  As a matter of law, his visitor visa was automatically revoked once he overstayed.  He was refused entry for lack of a valid visa.
