My USC husband was upset on me on our interview date and withdrew petition. (It's long story including stopping pregnancy before). And my i485 was denied (of course).  I'm not sure what reason he wrote and sign. I'm thinking he said that it was sham marriage. But if it was so, am I the only one who is guilty? Is he innocent ? I made FOIA request and there I couldn't find reason of withdrawing petition. Do you have any ideas what reason could he wrote there???? because I know he had no any problems after that. what is the next step of immigration?

What do you mean who is guilty and who is not? That's not up to us to judge we have no idea!

 

And what he wrote? Again we can guess a hundred things but we don't know he could have simple written that he wanted to withdraw his I-485.

 

Next step? Well are you still together? I'm guessing not since you ask those questions here and not him. So if he is not on board then your immigration path that way is dead.

hi. I started WAVA process in January. I just send i 360. Immigration situation is very hard today, so I don't know if I'm allowed to have any hope to win this case. I just want to know if anybody goes this process now, and if anybody have any updates. and if anybody had lately VAWA process, how long did it take? thanks.

The I-485 isn't his application so he couldn't have withdrawn that. 

 

He could have pulled his I-864, and, if filed, an I-130, which would have had the effect of making the I-485 unapprovable.

You're all over the place here.  If you had problems physically with abuse your best recourse is to seek out counseling for your VAWA case to solidify claims that you neglected to report.

Please don't be sorry. I already used to it :)  that there is no justice for me. Lawyers didn't recommend to do anything at all. Thay said if immigration thinks it's sham, there is no other way. and i think they are right . So I did it myself without any help. I just filled that maybe anyone will at least read my story. And I did it for myself, I have no proof, I have no right to say any word, because it's nothing against my USC husband. Even here, After years I wrote one word and some people got angry  :)) it hurts. I don't have family. I'm alone.

Do you have the hospital records of the abuse?  You may be able to use that as some proof.

USCIS do not simply take someone's word about marriage fraud and sham marriages. They act upon receiving clear indicative proof--and even then it needs to be really good, because "my husband/wife only married me for a green card" is a story they hear day in, day out.
