We asked to talked to a supervisor before, is it the same thing as a "real io"? Today the lady from the window checked the status of i-130 and said that it is on the officer's desk and the officer just "needs to pick it up and work on it" and nothing was mailed to us regarding i-130.

We will go again in 3 weeks, i guess there is no point to ask for IO right? Since the first person from the window could see the location of the file.

The plan is to try info pass again in 3 weeks or so and in 2 month after the interview (after feb 27) start wandering up on floors again  I just don't know what else to do, last time they forgot about the case for a whole year....

On March 10 will be 2 years and i-130 is still pending

It sounds like you are doing the right thing. Make sure you document all these interactions with them  Keep staying on top of it! I feel like that lawyer should be of more use ..

Bonus for the AOS taking so long, you will get a 10 year green card vs 2 year!  Which means no ROC.

Thank you  yeah, our lawyer just likes to send useless service requests every 2-4 months, that's it

Next time you go request a real immigration officer, they see more on the screen than a front desk supervisor.

@banana_princess Have you consider to file a complaint against the Immigration Service in the Federal Court? I heard of people doing that, but not sure what's the winning chance. Plus lawyers are expensive.

Are you talking about a writ of mandamus or something else? I don't think there is a point to file the writ right now... but yeah, we thought about it before. I believe it works better in the situations when they don't work on your case at all, right? And we kind of made them do stuff about our case by going there. Lets say if we file WOM now they will just give us the noid like they said, so it won't change anything, you know what i mean. We can get the noid by going there and talking to the officer again, filing the WOM will only take longer and be more expensive. May be after we respond to the NOID if they take a long time again...? But then again, what the point to spend all the money if we can just go there and see the officer/her supervisor again. Is there a point, i don't know? 

But is there some other complaint we can file now, do you know? Because yes i would love to complain to someone that uscis can't do their job  If they are willing to deny a legitimate couple who submitted everything that was required then most likely they approve fraud marriages by mistake, so something must be wrong over there  29 days since the 2nd interview, still nothing, i just don't understand why are they doing this to us. Seems like they just refuse to do anything about our case on their own and doing whatever they can for the case not to move, why.... are they hoping we will withdraw it or something, again, why..... May be they actually don't like that my husband was married before and since they can't find a reason to deny they just hope he will withdraw his second application eventually? But this is just ridiculous, they have no right to do that.

Oh and also i wanted to ask you guys, i don't think i should create a whole separate topic for that. If someone comes to our apartment, do we have a right to document it - like take pictures of them being in our apartment? Because clearly we live together, so I'm thinking if uscis is trying to find reasons to deny us and they won't find anything in our apartment that can help them to do that, eventually they will just say they never came to our apartment (like if we go to the judge, I'm not really sure how it works...), and i would like it if we have a proof that they came and saw us living together.

Tbqh, I think if they do a house check THEY have to document it. They don't just drive around and out of the blue pick a house to check, it's most likely scheduled on their end and just a surprise to you. Those things probably stay in the system, much like edits showing when anything is changed on a document.

 Also if you think that they'll go as far as go to your house then deny doing so, you may have more problems in this whole thing than you realize.

I've been through a home visit. They schedule them on their end, but you just never know about it. It will be listed in your A number file. You also don't want to be taking pics of them with phones unless you would like them to possibly go through those as well. You want a home visit to be smooth and painless and that won't happen if you're all over them, ours was like 5min maybe less to make sure we were both there, agent actually just stood in the entryway the whole time....and it was early morning, as in the time scam couples won't be in bed together. We answered the door with hair sticking up in pajamas LOL and explained we have sleeping kids here. The agent was very polite but I got the vibe that if we had not also been polite and helpful and just let him do his thing, he could have morphed into rudeness quick.

 

Your proof will be by asking them for their card and keeping it. You should be given one without asking, but they carry them just so you know.

Yeah i would actually, why not. I was planning to send them text messages between us and our friends with conversations that show that we are married for good in response to the noid. They are also free to go to att and ask for transcripts of our messages for the last 4 years, i don't care, whatever....

Ugh... like what? Can you think of anything?  yeah i thought so because to me it just seems like they just want to deny us and that's all, don't know why, may there is some plan or something to deny every 15th case, i just don't know what else to think. Which is why since i know that they can't possible find anything in our apartment showing that we don't live together (because of course we do!), they may just not use it in their decision...

My two cents, and I am no lawyer just my personal opinion. Never volunteer or present things unless asked for it. If it looks like they are hunting for a reason to deny you, things can be twisted including phone text and browser histories. It is just better if you don't go even deeper down that rabbit hole IMO. Something is amiss with your case and your attitude of whatever, let them check it all could be throwing fuel on the fire. I'm advising you as someone who has been there, done that, sat in deportation court even due to having the wrong starting attitude about some things immigration wise. 

 

After I've spent close to 7,000 on legal fees, caution is the name of the game and should be yours as well til you find out what is bringing them so hard on you guys.
