Why are you making such negative assumptions? Not everyone is fraudulent. It probably didn't work out for them while being on a K1 visa, that happens.We can't make just any assumptions wihout knowing the full story.

I didnt say her relationship was fraudulant.

I SAID her entering on a b2 after a k1 marrying can be looked at as intent to migrate on a non immigrant visa.

Looked as not IS.

If they did not lie to get the tourist visa, and they did not lie to CBP upon entry, then intent is not an issue. Even if there was intent, that alone is not a reason to deny AOS for a USC spouse.

I think she does have intent.

Here's why. When you do a k1 you state that you intend to marry. She left due to (who even knows toooo many stories to count) ......so now she got by CPB with a visa that should have been cancelled when she used her k1.

Now she's back....I think marrying will show intent.

Just me thinking

That's a nice opinion and all, but since OP already entered through their POE and the CBP office who had the actual authority to determine whether there was intent decided there wasn't so... Kind of a moot point that makes it seem like you just want to stir the pot.

OP can file to Adjust. No one here has to agree with it personally, but your moral opinions or whatever really aren't relevant at all since that's the fact of the matter.

I am honest, just keep in your mind that life is full of mysterious. I do not want to write an essay on here. I just asked for some advise for the three options out there for us. So if you do not have anything good to offer then thanks for not saying something negative.

I just stated what it can look like intent not that your relationship is false or fraduelent.

You didnt intend on marrying on the b2 then like EM said you can do option 3.

Honestly if I "accepted" all advice I have received on here as gospel it's entirely possible that my husband never would have made it here.

Thankfully it's a lot easier to sort through good and bad advice after hanging around for a while!

Just to recoup: OP is in the US right now. Unless he's lied to CBP, he's good to get married and file AOS.

Intent alone is NOT a reason to deny an immediate relative of a USC's AOS application.
