K1 visa for the second time for the same person in less than 1 year

Hello everyone

I am currently in the U.S on my B1B2 visa visiting my Fiancé. We filed for the K1 visa last year and I came here in August but we did not get married and I left the country. We are now together and happy to stay together. We are asking for some advise that lets us be together ligaly.

We did some research and based on what we found we have three options which are;

1- Re filing for the second K1 visa while I am in the state and go back to my country for the Medical exam and the interview..etc.

2- Getting married here and filing for the CR1 Suppose married visa. Which we think this is much more longer than K1 visa.

3- Getting married and applying for AOS which is not our favorite one because we do not want to do anything seems illegal.

If you did not enter with intent to do 3), there is nothing illegal about it.

I think she does have intent.

Here's why. When you do a k1 you state that you intend to marry. She left due to (who even knows toooo many stories to count) ......so now she got by CPB with a visa that should have been cancelled when she used her k1.

Now she's back....I think marrying will show intent.

It's all assumptions. A different assumption could be that he left after they decided not to marry (maybe due some problems in the relationship) and came back on a B2 just to see if they can work out their problems.

Turned out they did so now they want to get married and file for AOS.

Why are you making such negative assumptions? Not everyone is fraudulent. It probably didn't work out for them while being on a K1 visa, that happens. We can't make just any assumptions wihout knowing the full story.

He clearly states 'he went home for an emergency because he had to leave and was wondering if he would be able to visit on the B2'

everyone said it would be denied, well i guess it wasnt... lol

i guess it depends what you said to get your B2 not revoked and if they asked if u were engaged ect...
