This is absolutely untrue. Do NOT be fooled by the recent handling of the email crimes into believing that one must be aware of what they are doing.

It's true that the opening sentence of the USC references knowledge & wilfulness, because that is often the intent of the accused. But even mishandling it unknowingly (allowing it to be potentially compromised, even without the holder's knowledge) makes you subject to criminal penalties. MANY people have lost security clearances and gone to jail just for having classified data on a non-classified device, even if said data was always properly protected from prying eyes. Just having secret data on a non-marked USB stick, properly stored in a secure vault, can land you in jail.

If the FBI determines that any of the documents that ended up on the shared device were classified, Abedin could be deemed to have mishandled them. In order to prove that was a criminal offense, however, investigators would have to establish that Abedin had intended to disclose the contents of those classified documents, or that she knew she was mishandling that information.

What we know-FBI found some emails on a new device.

What we don't know-what's in them or if they're copies or if they're classified. That's it.

Comey has implicated Abedin, but hasn't mentioned her by name. FBI doesn't go out and talk about ongoing investigations ever.

I think Comey is in a tough spot. We have no proof that these emails are anything to anybody but that has not been ruled out. Additionally we dont' even know if these "potentially relevant" emails are were sent to or from Hillary and this server. This apparently needs to be ruled out.

If these emails turn out to be relevant ( criminal or not it may take weeks to decide) AND the FBI said nothing to congress, they have a bulleye for hiding information. Just this letter has given Trump the fodder to scream that this ir proof crimes had been commited.

In the current case all we do know is EMAIL , CLINTON and nothing else.

My only speculation is that on initial review they found some interesting emails on Huma's machine that she shared with Carlos Danger. The question is did Carlos have security clearance to see them? Did they originate from Clinton's home server? Were they forwarded to someone that shouldn't have them? Did Huma and or Hillary state to the FBI that all the devices with emails from Hillary's server were destroyed? As to Hillary being implicated, I think this would only be if she were emailing Huma to a private address with confidential information. I know with POTUS any correspondence they originate is considered confidential by nature, not sure if the same applies to the SOS.

Hillary should not be prevented from running. The real question is what kind of person would remain running given all their corruption clouds that are now becoming clear?
