Recieved a 221G, but for an unusual reason...wanted to see if anyone has experience with this particular situation

Hello all (:

So my husband had his interview on September 27th at the Mumbai consulate. The co asked him all the normal, run of the mill questions and within a few minutes she said his visa was approved and gave him all the necessary paperwork. He told her we would like to wait until our second wedding anniversary, which is in March, to travel to the states, so we could avoid having to lift the conditions in 2 years. She gave him 2 options, either he could take the CR1 visa, or she could give him a 221G for a new medical exam, we get the exam in January of 2017, and submit it along with his passport at a visa drop off center, at which point we will receive an IR1 visa. I wanted to see if anyone else here has had a similar experience. I was also curious if it will take the embassy a long time to process my husbands visa, since technically he was already approved. Ive heard it could take several weeks to several months, but I feel that's for people who truly did forget certain documents, need further processing, ect.

I do not know about Ap in India, but Ap can be weeks,months, years...(no one can predict) If you ask me or most people in VJ about it, I will answer; It's so frustrating, so much wait and they can deny you in the end.
Ps: You shouldn't choose it over approval.

I highly doubt we will be denied, in fact I know we won't . We didn't get a "normal" 221G. My husband was approved and she gave us an option. She could've just made us take the CR1 visa.

Personally, I would have just gotten the CR1 visa instead of waiting 6 more months before making your PoE. I have never seen or heard of anyone else in this scenario, but I would guess based upon what you were told that once he submits his passport and new medical, the visa will be processed in whatever time is standard for your embassy.

Ir1 vs cr1 is decided at poe not approved visa. However a few other members have described a similar situation to yours.

Our anniversary is on March 11th. The medical exam would expire on March 22nd, Im assuming she figured getting the visa back to us would take longer than 11 days. The co told my husband to take his new medical exam and passport to a drop off center on or after our 2nd anniversary. I just don't understand how we would be denied when my husband was originally approved at his interview. I wish she could've given us something other than a 221G for our particular situation.

221g is not denied, its ap. She put you in ap. I would have just moved and dealt with roc personally.

Not likely. Even then it would be sent back to the USCIS first.

if I were you, I would take the visa right now..

I can't take any chances with a new CO going over your case and coming up with something minute to make a fuss about.

The CO has to either approve and issue the visa or give a 221g.

There is no "applicant wants to wait because he wants to get 10 yr GC and not ROC" paper !
The 221g makes the most sense and hopefully they will still honor what you were told and issue the visa later.

Let me try to clarify things a little. Sometimes in cases, you are in AP for a very long time. Days, months, years, it can be extremely fast or extremely slow. There have been cases where after being in AP for a long time, several months even, that people were denied the visa. They were told the are approved, go into AP, then receive word after some time that there case is denied and being sent back to USCIS. I have only seen this happen with K-1 visas though. Not CR1 or IR1. Not saying it hasn't happened, but I haven't seen it with anything else but a K1. If anyone has, feel free to post links please.
