Please help me! I came here on K1 visa, got married last year Dec 2015. Received my 2 yrs GC on June 2016 and now I got pregnant, my husband and I are not in good terms & we had a talk about getting a divorce. What can I do? Please help me..

Immigration wise you can file I-751 removal of conditions with divorce waiver once the divorce is finalized.

As for spousal support / child support (in the future), you have to discuss it during your divorce proceedings.

My husband called USCIS and asked what's their advice about having a baby and getting divorce. And he told me that he doesn't want to hear anything from me if he is going to date other women.

Chances are really ridiculously slim. Advice has already been given on removing conditions following the divorce. She'll need to collect evidence of the marriage, which would be good to do now.

You can file to remove conditions on your own without your husband's signature using a divorce waiver. You'll need your divorce decree and also send proof of bona fide marriage ( joint financial liabilities, bills, insurance plans, lease/mortgage etc) to show marriage wasn't entered solely to circumvent immigrant law to procure a green card. With that you should be able to remove conditions on your own.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

12/02/2017: Mailed N 400 to Phoenix, AZ Lockbox. (I-751 still pending)

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

Childs best interest is always with mom unless ruled unfit.

However I see it hard for her to remove child from the USA with out dad allowing it.


Will USCIS send her back to PH? With or without her kid? I think that's what she wants to hear.

my thoughts to you don't leave the US at all, have the baby born here. You can apply for health benefits from the government or the county where u live if u don't have one, 100% u will be approved if u mention them that your pregnant. the baby will be the proof that you entered the marriage with good faith when you apply to remove the conditions of GC soon.

A baby only proves you have sexual contact.
