when people find love and things like this happened. If you have a solution to her case please kindly offer to assist if u can. In this journey so far it has always been a sweet/bitter experience with the so call IO at various us consulates in the world. If u attempt this process and got it once doesn't mean you know it better than others that are denied. It's just a game of luck. Many couples with genuine relationships in this forum also face issues like this. This has nothing to do with age difference or having a step daughter. Please look into the refusal letter very well and retrace where the errors come from and correct it. In due time your man will be reschedule for an interview. For those that believe life is all about greencard,or that was duped in their previous relationship. Please get a life. This lady is talking about her man and how to get him here in due course.

It's more than a game of luck.

The refusal letter did not state the problem.

It had everything to do with the daughter.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Thank you for your suggestions. Yes, he went over the events of the interview, and I believe it had something to do with the mother of his daughter, who he hasn't even seen in 7 years. the CO kept asking questions about her, and because my husband hasn't seen her, he had a hard time answering the questions. I believe this is the reason.

I've contacted my congressperson and am waiting for the immigration person to call me back.

Hoping you can convince the CO that the daughter will be well taken care of and not feel abandoned by her father, after her mother already

did.

Even if she is taken care of financially, emotionally losing both of her parents just makes me immensely sad and must be troubling the CO too.

Hoping you will be granted a second interview, if not you get your rebuttal chance with the NOID/NOIR letter.

A FOIA can take as long as receiving the NOID/NOIR so not sure if it will help but it's worth a try. Make sure you are very specific with

the FOIA request and you both must sign the FOIA release form to get the best answer back.

Ikemne stop been a critic, i am a single mother, if i am in ghana and my fanacies are not good, let me tell you i will leave my kids and come to America,anyway where you are from people don't do that, judge? Be in her shoes.these consulars in ghana are so evil they want to separate love ones.they did the same thing to me,do you know how much evidence we have,i went with my husband to the interview .the consular didn't look at what we had they just don't care ghana embassy.

At times the tone from other VJ posters may seem harsh. This is true but the fact of the matter is the Petitioner has received insight into the lens of the CO. Her consulate is not an easy one. She needs to be armed and informed not just coddled and pacified. I think it would be a disservice to her efforts not to make these issues clear. I will echo what has previously been said. Try to take a step back and detach your personal feelings for just a moment. Look at the entire scenario and how your case has been presented as if you were an incredulous CO with the underlying belief that all cases are fraudulent. Now craft your argument. Search for similar cases that have been overturned for possible strategies. Build your case and go get your husband. Keep the faith.

Really? I'm a single mom too, and if I were in Ghana and my finances weren't good and I met someone from America who is willing to petition for me to come to America...guess what?? I'm taking my child too! How much more effort does it take to include the child? Is she not worth it? And Im not sure what you mean "where you are from people dont do that judge", I would be happy to respond to that if you could clarify. Im not sure why you are jumping on me...I was actually being quite nice. I don't think it's being critical when you are stating the obvious!

Sorry to hear about your situation, Lutz. Don't lose hope, I have seen many red flags in cases that do get overcome.

As you stated before, you could not afford to bring your daughter over. Maybe try and get a sponsor to assist in bringing the child over? That possibly could help your case.

I dont think a sponsor is the issue. She "owns" a house in Ghana, a car in Ghana, and since she doesn't like to rent, I'm assuming her home in the US is owned as well. I do believe her assets alone would qualify her to be a sole sponsor.

Lutz, you've stated that your husband's finances are not good in Ghana. So aside from the house and car, Im guessing you assist him in his day to day expenses, including those of his child. What happens when he leaves? If you can't afford to have her there...will you still be able to assist her financially in Ghana until he gets on his feet and starts working in the US? Or is she going to get left high and dry? What about the house expenses for your house that she will be living in? I lived in Ghana several years in a RENTED house. Its costly. Electricity, water, gas for cooking, garbage pick up, Dstv, etc. It makes more sense to have her with you. Rent the house in Ghana and use that money to help 'afford' the child in the States.

These are issues the CO is going to address and need answered. I think we all agree how hard the Embassy in Ghana is. He might not have had to be clear and concise with certain answers to you, but he surely will with the CO.

Wow, this is so scary. I googled around this morning and read about marriage scams and as many of the people here have explained it could look like a textbook case where the sister is actually the wife. I'd never have thought of that... I mean of course it could go either way, but I'd be so careful Lutz and I wish you the best of luck. Many here are really only trying to open up the big picture as to why the CO officer did what he did and I can't blame them. I'd want to know too.

Thank you all commenters.

First, I really do appreciate all comments because it has opened my eyes to how the CO thinks. I'm not a babe in the woods, but because I haven't had this experience in my life, especially with an embassy like Ghana, I simply didn't know many things.

Second, I don't take the judgmentally toned posts to heart. No one knows my husband and no one knows me and what we've been through, and I don't care to tell anyone too much of our personal life. I can see where judgment and suppositions come from, that is just human nature.

Ghana is a tough place to live, and if you are a person commenting from a relatively comfortable country, you will see this situation through those comfortable eyes and judge. I really don't care about that.

So again, thank you. Now I will know how to fight this situation.

Lutz, looks like the daughter is the "problem".

This has happened to my uncle before. His wife was denied because the my uncle didn't include the step daughter. CO told the wife to either add the daughter to get approved or forget it.

They added the daughter and they all got approved.

On the other hand, my sister and I were removed from my mother's application in other to get approved. So my family was separated in other to immigrate here.

It is all up to the CO.

If the CO decides what she or he wants to do, you do that or be prepared for an uphill battle.

If i were you, I would engage in that war with them. you will only frustrate yourself and prolong the process.

Thank you for your response. Yes, we may have to do that. I am meeting with a lawyer today. I plan to fight the denial, but am willing to do whatever it takes to get my husband here. Thank you again, the support I've found here on VJ has been very, very helpful

I posted last week about my Ghanaian husband's CR1 denial, and VJ members helped a lot in opening my eyes about his daughter and how the CO may view her not immigrating with him. Thank you for all that.

I do seek some more input.......the CO also asked my husband a lot about my friends here in the States. She asked about it at the beginning of the interview, then stayed on the topic of his daughter for a while, then went back and asked again about my friends.

He's heard me speak of two of my friends, both female, here in the states. He told the CO we go out to restaurants etc. What do think this can mean, her staying on this subject, and actually returning to it.

After the final question about my friends is when she closed down the interview and told my husband the case is being sent back to USCIS. I understand now about the daughter, but I'm racking my brain to figure out the questions about my friends. I'm not a kid, so I don't see how friends are so important.

Most likely looking to see how much he knows about your friends. It is an interview tactic to question then move on to other topics and re ask the questions so that they can see if the answers change. Since he is married to you the interviewer wants to know how much your partner is involved in your life and how much they know of you and your friends.
