Me and Wife needs to leave to country SOON during AOS processing!

Hello Everyone,

Me and my Wife had a very small wedding at the city hall when she came over. She has a big family back overseas and we have scheduled to have a wedding there at church and with all her family. The thing is that everything is set up and ready to go, we will be married in front of God on July 18th. Her AOS documents are being processed at the moment, so we will need to file for Advance Parole. What shocks me is that the average processing time is 90 days, which is too late for us.

I may have gotten myself into some trouble, I know I should have applied for Advance Parole sooner, but its too late now.

There is an expedited process though, if you qualify. Do you think USCIS will accept an expedited/emergency advance parole application in our case?

We have gotten a letter from the church pastor saying that we have a wedding at a specified date. I am currently getting it translated.

Is there anything else I can do to help myself out in this situation?

You have to prove why your case should be expedited, the USCIS website gives you reason why it can be and you must meet one of these requirements. You can give it a go but...............

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met.

You can make an expedite request by contacting the National Customer Service Center (NCSC) at 1-800-375-5283. The NCSC will take a “service request” and forward your expedite request to the office with jurisdiction over the application or petition. You also have the options of 1). visiting your local office by scheduling an InfoPass appointment or 2). writing a letter to the local office or service center.

I highly doubt that in this given case USCIS would expedite your wife's AP. Concentrate on AOS for now and once she has her AP or green card you two can have a big wedding in her country.

I doubt you will even get an expedite processed within that time frame. I would be betting on the fact that you will not get your AP before you need to leave.

Your AOS is the most important thing to be focusing on right now.

When did you file AOS? Have you done biometrics?

I filed AOS and EAD but not AP. After a month I decided that AP could be good to have and filed for it. I included my NOA1 for AOS and my stamped biometrics appointment letter with the rest of the required documents and I got approved in 20 days. Did not expedite or call at all. So if you file now you might get it before you leave the country.

Do not leave the US without the green card in hand, or an Advanced Parole. Postpone the wedding. It is far easier to reschedule a wedding then to have your bride denied re-entry into the US upon return.

A wedding is not considered an extreme emergent reason for expedite, they are not going to care that it was bad planning on your part. Postpone the wedding.

Send that AP application asap and then when everything is in their systems, make an infopass appointment and bring all the proof you have. It HAS happened that some people got approved for emergency AP for weddings but dont get your hopes up. Be prepared with Plan B moving the wedding day) as this is more likely to happen.

I'm going to try to do everything I can to push it through, my wife is in tears because of this so I just must get that advance parole.

Here is my plan:

-Schedule and Infopass appointment to talk to a rep, try to get an expedited advance parole

-If not granted, I will file for advance parole

-Make more infopass appointments and see if I can get advance parole expedited.

Also I have read that some people left the country during the processing of their advance parole, when coming back they usually had the advance parole done and just shipped it overseas to the applicant so they can reenter the US with it. I this is probably not allowed correct?

They will know you/your wife departed before having AP approved. That would be very risky to do in my opinion. Most likely you will have to move the date of the wedding. Like others said, Immigration dont work around your plans. You have to adapte your plans to immigration timelines. Sad but true.

File for Advance Parole (that can takes between 1 and 3 months to get approved). I would move the wedding date for later.

Dont leave the country before AP in hand. By the way, did you apply for EAD when you did AOS?

If you could do us the favor and fill out your timeline and update your local CIS office that might help. I filed for AOS at the end of February and expect to hear from them in the next week hopefully for AP. By my count you have 70 days for them to receive and process your AP w/o expedite. If your case is similar to Washburn (AOS NOA1 received and Biometrics done), I'd get my AP sent in today. Who knows, maybe it will get connected to your EAD processing and your wait will only be 45 days.
