They will grant you the AP but those who overstay should not leave.

Per Matter of Arrabally and Yerrabelly, an alien with a pending adjustment of status application and who also receives Advance Parole is no longer subject to the overstay bars.

RE: Flu Vaccine

You can delay your paperwork until after the Flu Season when the CDC recommendation no longer applies and then the civil surgeon will not be required to administer it. Relax about the flu shot conspiracy.

Required vaccines are age sensitive. If you lack vaccine documentation and are in your 30's, I would expect to get a Flu Shot and TD (tetaneus and diphtheria or ask for TdAP and get pertussis covered too). Most likely you have an MMR and your Rubella titers from serum will come back with immunity for around the same price as an additional MMR shot. They'll run a VDRL/RPR for Syphilis on serum also and a Tuberculin scratch test (or pay upgrade for IGRA from serum instead).

RE: Tele-commuting long-term. Suggest you get a legal opinion somewhere on this.

To clarify a few things, I am not working here in that sense, the reason I wrote I have to leave for my work is I am a music producer DJ, and haven't worked here illegally. Any shows I have done the clubs always pay cash. But the reason I will need to leave the country as soon as possible is I have been turning down tours and shows in Europe where I get most of my income from.

Other than that I run a record label based in Sweden, so I haven't been working here in that sense illegally.


For all people saying I have to get the flu shot, do you know if there's any way around this at all.

I consider these flu shots to be pure poison and people from sweden and finland had some awful side effects including narcolepsy and other awful syndromes of the side effects.

My situation might be a little bit different than yours.

I came her as F1 student and went to college for a year and overstayed for years since I could not go back to college anymore.

I applied AOS in August 2014 and was approved in November 2014. It took a little bit less than 3 months.

Don't stress out and everything will be fine.

I came in on a CR-1 visa, the vaccination requirements are the same. I was up to date on everything, but the flu shot was mandated. It doesn't hurt, I didn't get sick and I didn't die.

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Working in the states for cash is still working here illegally.

The one that caused narcolepsy was from Finland. It was during a time when people where freaking out about the flu because so many people where dying. Finland was working on a new flu vaccine and they got approved to start using it even though the vaccine had not gone through all the stages of testing. Normally vaccinating is not poision and is recommended to protect people around you such as small children and older people with fragile health.

This year you might get away with not using the flu shot based on the fact that the flu has mutated and is not going to be affected by the flu vaccine this year.

You do not need a lawyer. File 130 petition asap to begin. Follow steps in forum and guides. Formulate questions to ask on V J. Many experienced members such as Ryan that you can trust to be correct.

State doesn't matter.

Consider using local county health clinic for shots prior to C S visit to save money. Mine were 23 dollars.

Also after we got married (3 weeks ago) are there any other steps we need to take to register or get the marriage validated? Or is the Marriage license/certificate we got at the chapel sufficient for the legality of the marriage?

I believe you can file the I-130 (the Petition for an Alien Relative that your wife will file) and the I-485 (your application to adjust status to permanent residency) at the same time as one big packet. When we did it, we found this guide really helpful: http://www.visajourney.com/content/i130guide2

It took some time to understand what we needed, figure out how to fill out the forms, gather the documents necessary, get his medical examination, get photos taken, etc.

The marriage license and marriage certificate are two different things, I think. A marriage license is something you get before the wedding that allows you to get married, and the marriage certificate is a proof of marriage. The marriage certificate should be all you need for marriage legality.

The I-130 instructions say:

Answer all questions fully and accurately. State that an item is not applicable with "N/A." If the answer is none, write "none."

So I think you would put 'none'.

All the forms need to be send as a big packet. Everything together.

You don't have registration number so just put None.

Usually they send you a marriage certificate you ask online copies, it's $10 so ask for a couple of them to have.

I remembered about something...

There is people who doesn't have the money at the moment for the medical and then they send everything but the medical. They get an RFE saying to send it when they have it or bring it at the interview. So if you want to try to avoid the flu shot, MAYBE that way if your interview takes a few months by the time you have the interview flu shot wouldn't be necessary.... But it's not 100% sure... Some people have their interviews very fast others take months.... I'm waiting since September but lots of people from my month already passed it. Was just an idea to give you

In USA, you must consummate the marriage for it to be valid.

This can be a bothersome procedure; but the two of you just must grit your teeth and do it.

Hello everyone,

My situation is really starting to stress me and my partner, and I found this forum in hope for some assistance from you people who are more informed than I/we are in this matter.

I have currently been living in the US for just over 2 years, I entered on a 90 day tourist visa and have overstayed for a LONG time now, but met my wife and we decided to get married which we now are.

I did not enter the US with the intent of getting married, and the reason for me staying was that I had met my wife but didn't know if we would end up getting married or not, but I didn't want to leave.

We are now married as stated above, and we can't really afford to hire expensive attorneys but need this process to hurry up since I need to e able to leave the country without being banned forever, since the field of work I am in will require me leaving at some point sooner rather than later. I am swedish and she is a US citizen of course, and any help or advice in what paperworks we need to file, in what order, and if I need blood works taken for my application is greatly appreciated.

If anyone has been in the same situation or have any help to provide I/we would be forever grateful.

Since I am currently in the US I can't really find anywhere where this is an option for filing paperworks, all I can find is the k1 where I would be allowed to enter from Sweden to America, but since I am already here, what do I do? And in which steps do I take everything?

Did you enter on a B1/B2 tourist visa or VWP (visa waiver program)? The 90 days stay you mentioned sounds like VWP, which make your adjustment of status to permanent resident more 'challenging'.
