Seriously look at the K2. I think it is doable.

Follow to join should be really quick. You pay for the K2 visa and he does the interview and poof done.

do I need to file for anything here in the u.s for that. or should I just got to the Philippines and schedule an appointment for my son.

Hi,

It's my first time here and I wanted to ask for an advice for my 5yr.old son that I wanted to get from the Philippines and I'm in the US as a permanent resident or green card holder. I just sent my petition today and I wanted to get him as soon as I can bec. he broke his right arm bec.no body really looks after him like I do. You know how kids are. Any thoughts? Its under IR2- Unmarried Child Under 21 Years of Age of a U.S. Citizen, your son is considered stepchild of your husband. Thats the fastest way to get your son.

dessa0202 you can try calling the consulate tell your a green card holder in the us and would like to have my 5 yr son follow to join can you please help me, call the consulate talk to some one in charge hope it works the form 1-824 read the eligibility requirements immediate family members.the other thing is your us spouse can file for your son.give it a try call the consulate. good luck

Contact the consulate immediately to ask about the process for the follow to join. Let them know you only have about a month left for him to follow to join. He will need the DS-160, pay the visa processing fee, get a medical, etc. He needs pretty much what you did for the K-1.

I would just like to clarify, the FTJ is only available within 1 year after the K1's visa is issued, not when she entered the US. According to the OP, she entered on Oct 28, 2013. I'm not sure if she mentioned when her visa was issued, but whatever issue date is on her K1 visa is when the 1 year starts.

If it says October 18, the window of time is very limited so she has to contact the NVC promptly and request and expedited interview if at all possible. The visa has to be issued before that date.

With the NVC being so slow, she may not have a choice but to proceed with the IR2 route however. Here is a link with instructions about what you need to request the FTJ from the NVC:

Hi Guys,

I tried calling the USCIS , NVC and the US embassy in manila they all advice me that I only have limited time left. I just sent the follow to joint papers to NVC via email. I think I only have a very slim chance here, (I even booked a flight already but this can be cancelled anyway) Will see what the NVC says within Friday if no response yet then I would just cancel the follow to joint and proceed no the I-130 and will let my husband US citizen file for him so this can be process quick. Thanks for all your help I appreciate it a lot. I'll let you know what happened. This is so stressful I haven't eat and just slept for a few hrs bec.of this. Im sure it will be worth it. Godbless you all.
