Need some serious advice.

Hello,

I had a kid with a foreign person and long story short, I love with my son, but we fight with his mother all the time. I want to bring him here so I can be part of his life, but his mother would have to come with him to take care of him and because I'm afraid if I bring him here alone, he might get sick from not seeing his mother.

My idea is to apply for K1 visa for her, but I'm not sure if I'm making the biggest mistake of my life yet again. So, my question is, wiilll the people at the interview figure out that we can barely stand each other? I mean we don't have a wedding ring, or any kind of excitement towards getting married, I am just basically doing this so I can be with my kid.

Any thoughts, comments, advice??

There is no requirement to be in love.

You both must have the intent to marry within 90 days of her entry with the K-1 visa. You need to be willing and wanting to marry and make your marriage and family unit work. If that is the case, then go ahead and apply. If you think bringing her here to marry her would be the biggest mistake of your life, then don't do it. Get your child a US passport and have frequent visits. See if the mother is willing and able to move to a country that is closer so you could visit easier. Only you two can decide what is best for your lives and that of your child. Think it through well before deciding.

If you are doing that because of your son, that's not a purpose of K-1 visa. K-1 visa purpose is bring a fiancé(e) of US citizen in the US and get married within 90 days. You can do whatever you want but no one here would advise to bring the mother of your son in order you can live with your son. That's up to your choice, anyhow. But be aware that consular officers would see things differently. They are well trained to see what people don't see.

Quite pure one. You will have to provide statement that you intend to marry within 90 days - which - as you clearly stated is not your intent at all. In addition, if she comes on K-1 and you don't marry, it doesn't give her absolutely any right to live in US, she won't be even able to adjust status should she marry somebody else in the future. K-1 visa itself without marriage and subsequent adjustment of status is pretty bad choice to come to US.

Doesn't make any sense.

Thanks all for the responses, it is great to get this kind of feedback from people that have been through this process or are going through it. I guess my case is somewhat unique, and I have been feeling lost at times.

I definitely have plans to marry the mother of my son if I decide to start the K1 petition form and do everything according to the rules, if the relationship really doesn't work out I guess we'll cross that bridged when the time comes.

How difficult is it to start the process? besides the great info in this page, does anybody have any advice as far as doing this by myself or should I just get a lawyer?

They are going to want your communication logs as part of the evidence,

and if its all bickering between the two of you without much signs of love...

I think it'll raise a big red flag in your visa processing.

Perhaps, you can try to get them a visitors visa first, and try living with them

in the same house for about 1 month and see if everyone can stay happy.

In other words, give it a test run before you jump into this very iffy commitment.

If you can't stand her now and she in another country, will you be able to stand her if she gets here and you guys are living together. Remember once you guys marry and you decide to file for a divorce, she may be entitled to alimony and child support. How about you petition for your son and have him visit his mom on holiday breaks. I moved here w/o my mom once my dad petitioned and brought me to the U.S. I would go visit her every summer. Now I am in the process of petitioning for her and her case is in the initial review status.

go to family counseling visit her , go to a few sessions, talk

things over with her, ask her if she want to stop the fighting?

do U love her? if U do then do the right thing dude, kids need

both their parents, but in a safe secure loving environment

I would have to agree with the others suggesting to get your son and his mother a B1/B2 visa first. See how it goes, if you two can work it out living together with less bickering and fighting. Think it through before you decide to marry her.
