I spoke with a nice person at USCIS who told me about the current status of the "recalled applications" to the Vermont Service Center.

The "files" were recalled along with the "Petitions" from the foreign embassy. My petition was still on its way back to square one so I could be sent my IMBRA addition (ironic considering we met in USA and IMBRA is applied to all K-1 now).

So now she tells me that once my file and petition are in the office I will get my RFE and my case along with everyone else affected will be expedited. She said the RFE's sent out due to IMBRA will be mailed in bulk from the Vermont Service Center.

How can that be true if I am hearing that other people using the Vermont Service Center have already got their RFE's?

She said my case was of course recalled like everyone else's due to IMBRA, but I am hearing that other people have already gotten their RFE.

Let me if anyone is along the lines of my timeline and has heard back from the VSC.

Timeline

Can anyone share their two cents on the IMBRA law? I got an RFE today and just want to read other VJ members' thoughts about it. Do you guys think that these were just sent in bulk because on my account, it doesn't say that our papers have been touched. I am just wondering because I am expecting an RFE for something else and instead I got this one. Do you guys think that they sent the IMBRA RFE without even looking at each application?

We also received our RFE today. Our NOA1 is dated 15 March. Still no change on our status on line - according to status is hasn't been toched since NOA1 was mailed. So although we can all begin celebrating we received the RFEs I'm afraid we're not really any closer to a decision. Who knows.

8 May 2006: File Sent to NVC (as stated on email dated 9 May)

24 May 2006: NVC sends our file to London Embassy

8 June 2006: Packet 3 arrives (DAY 101)

25 August 2006: Pack 3 sent to London Embassy registered post

29 August 2006: London Embassy receives my Pack 3 - 9/9/06 pack 4 arrives

SEPT 2006:APPLICATION PUT ON HOLD - WE HAD A FALLING OUT.

MAY 2007:RESUMED THE VISA APPLICATION

6 June 2007: Medical @ 2.30pm - need to get anew GP letter and psychiatric evaluation

7 June 2007: INTERVIEW @ 10am - waiting for new police record letter

I recieved an RFE today. It asks three questions to be filled out and returned.

Question 1: Did you meet your fiancee or spose through an internationl marriage broker?

Question 2: Have you been convicted by a court of law or court martialed by a millitary tribunal for the following crimes: Domestic violence, sexual assualt, etc.. Murder,rape, torture or other viloent behaviors.

Question 3: If answer Yes to above question were you being battered or subjected to cruelty and acted in self-defense?

So those are the questions on the form.

This form is the new supplement to the I-129f due to the IMBRA International Marriage Broker Regulation Act of 2005. In light of this new amendment USCIS requests you fill out and complete the form and sumbit it with your I-129F.

I wish I knew about this form before so I would not have to fill it out and take away time from my process. I did mention in my paper work I sent in that I did not go through a marriage broker and that I met my fiancee in person however it seems that USCIS now requires this form along with your I-129-F. This needs to be updated on the main page then if that is the case.

No, the guides do not have to be updated to reflect this as the RFE only applies to those that filed with the old form. The new I-129F that has been available for a while now covers the questions within it.

I noticed somebody asked a week or so ago if there was a list of all RFEs so people could look out for possible "boo-boos." So here we go!

My RFE reason was;

The forms we downloaded didn't tell us to add evidence of meeting in the past two years or frontal face photographs. Which is weird because we got them directly off the London Embassy site. So we got an RFE for basically the other half of what you're suppost to send origionally. We started the K-1 appliciation before we found this forum so we were kinda just going with the instructions as best as we could. We say if you're just starting the I-129F download it from VJ...they seem to have the right instructions....

General Tips on Assembling Applications for Mailing

1. Mark both the envelope and the cover letter as to the nature of the submission. Example: ORIGINAL SUBMISSION - BRIEF FOR AN APPEAL - RESPONSE TO REQUEST FOR ADDITIONAL INFORMATION - etc.

2. Use the appropriate mailing address and mark both the envelope and the cover letter as to the form type. Example: I-129; I-130; I-690; I-698, etc.

3. Provide both the receipt notice number and the A-Number as an identifier, if they are available.

4. If the packet is being resubmitted in response to a REQUEST FOR ADDITIONAL EVIDENCE, please place the notice requesting the additional evidence/information on the top of the packet. Also, please use the special mailing envelope provided. (there is no special envelope)

06/30/06- sent I-129F petition to VSC.

07/11/06- NOA1 (received in mail)

07/19/06- RFE received in mail, IMBRA

07/28/06- e-mail, IMBRA RFE received at VSC

09/11/06- called VSC, told I'm with an adjudicating officer

09/25/06- called VSC, told to file expedited service, outside 60 days of RFE received date

09/26/06- sent expedited service request to VSC via fax and snail mail

09/26/06- Senators and Congressman making inquiries into my petition

09/29/06- expedited service request approved by VSC director

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)

That may be excellent advice for some situations, but not "always". In our case, we went through the whole process without ever sending in the USC's birth certificate at all (we used the passport to provide proof of citizenship).

Oh no. I sent only the "short form" of my birth certificate. Our state does have a long form option but it takes 6 weeks to obtain. And I didn't send copies of my passport pages.

Is it possible to make an addendum to an I-129F that's waiting for review. I already received NOA1 with case number. I wonder if I can "pre-empt" the RFE by sending my passport copies?

My fiancee also didnt include his passport copy together with the I-129F. We been put on RFE since April 11, 2006. gawnd and we just got the RFE detailed letter from USCIS July 14, 2006 and resend the documents needed July 17, 2006. Still waiting for NOA2. They never touched us yet!

April 27, 2012 -Finally Petition is approved!
