Timeline
After reading that some of you are receieving RFE's for your beneficiary's birth-certificate im worried that I will now receive one since I didn't submit my beneficiary's BC. Crossing my fingers that I don't. :unsure:

Me neither. I did not know originally. It has been about 2 months + one week now since NOA1. *crosses fingers too*

Let's hope ours will go through smoothly! :unsure:

I also didn't send my fiance's birth certificate...I really hope that it will be okay. In case, I will call him and try to get him to get the translation in preparation but I really don't want this to prolong our case for another month or so... :wacko::help:

- Sorry if this is obvious, but since I had had trouble with "short form" Vs "long form" birth certificates on other matters, I was very cautious. In Mass, the short form is just that, it looks like a 5X7 card you can carry around with you with the basic information and a seal. The long form is a 8 1/2 by 11 sheet of paper with all information (sorry I don't have both side by side so I cannot be more specific), again with a seal.

I had run into other situations where the short form was not sufficient. Early in the process I called the USCIS and asked for clarification, but did not get anywhere. I sent the long form to be on the safe side.

I have a question about my fiance's birth certificate. Does anyone have any experience with marrying a Chinese girl? She is having trouble obtaining the birth certificate and not sure where to go or how to get one. Thanks.

You might want to post this in the Regional Discussion part of the forum under China. Im sure there are people in that forum that can help you with your question or can direct you in the right direction.

My friend told me to have her get it and she got 4 stamped copies. I got 4 certified copies -planning to cover the bases but it's taking a long time to get everything "certified" copies.

Well I finally got the RFE I have been awaiting since Jan. 16. They sent it to my OLD address! Thus the delay. Geeze, I had received a letter from DHS to my NEW address confirming the change in early November! What do you make of that?!

In my initial I-129F I had only send 4 photos of us together and copies of my passport, showing arrival in Chennai in May 1989 and exit in Aug 2005.

Now I will search my apartment for further proof that I was in India, I guess. I have copies of the airline ticket and boarding pass stubs, I have Exit Permit issued by the Indian govt as well as visa renewals for every year I was there. I’ll only submit the ones from 2004 & 2005, I suppose. I never had credit cards there so… that’s out. Too bad I never got printouts of my bank statements, accounts which I closed when I left. I might have dollar to rupee exchange certificates with my name & address within the two years, which I can send.

Any other suggestions? For your info, please find the letter below.

LAST MEETING: the petitioner and the beneficiary must have met in person between October 17, 2004 and October 16, 2006. Submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition. The primary evidence may include copies of passport pages that show the identification page and admission stamps, military orders, letters from Commanding Officer, or any evidence that will help the Service to determine that the petitioner has met the beneficiary within the two years. The secondary evidence may be airline ticket stubs and receipts (that indicate month, day and year), ATM and credit card transactions, flight itinerary on airline/travel agency letterhead, etc. NOTE: secondary evidence is used to support any primary evidence that has been submitted. The following DOES NOT constitute evidence of meeting: disc, videos, emails, letters, phone bills, and greeting cards.

The petitioner may also submit bank statements and/or credit card statements and receipts showing that a withdrawal/purchase was made in INDIA. Please ensure that any documentation that is submitted has the petitioner’s name, location, and the full date (month, day and year).

AWW man, I never knew they wanted the beneficiary's BC. I filed for a K1 once before two years ago and that was never requested. Hope I don't get any RFE's.

By the way, with my packet, I bought a pack of index dividers and included a table of contents on page two of my cover letter. Here's what I included:

-G325A for both with two passport photos in a small ziplock bag stapled to the front of each

-hand written intent letters from both

-my birth certificate

-previous marriage certificate and divorce decree

-copy of my passort in it's entirety with stamps/visas from both trips to Amman

-copy of my fiance's first page in his passport

-copy of my boarding passes from both trips and various receipts from purchases i made there

-copy of receipt for the purchase of our engagement rings

-copy of a video clip (saved to cd) of a very small celebration

-about 50 pictures (about 4 photos to each plastic sleeve) *** be sure you write details on the back of each picture you send including your names on the back of those passport photos you send with the G325A

1st K-1 Journey:

June 2005 - filed

October 2005 - visa interview

March 2006 - AOS packet mailed

DIVORCED

June 2007 - Interview

2008 - 10 year approval

Hola, I'm new to this forum and want to say that it is wonderful to finally get some realistic answers, situations, and timelines. I am in Iowa and my fiancé is from Mexico. We were able to get her a tourist visa in July 2006 so we have been living together at my home in Iowa. She went back to Mexico in September and must return again in March. The problem is her 2 young children are still with the family in Mexico. It is a long story so do get the wrong idea. We are working on a K-1 Visa and we have hired an immigration lawyer to help. Our I-129 was sent October 20th and so far we've received notice that is was received (postal receipt) but nothing else until about 2 weeks ago when we were informed that our check was returned due to overpayment $190.00 instead of $170.00. I was told $190.00 by my lawyer but they didn't catch it before they sent it out. Isn't that what we have lawyers for? At anyrate, the correct amount was sent immediately and from all this I assume that they must have my information and are processing it. I've heard nothing more from my lawyer. We are hoping to get through all of this by May and have fiancé and children here at last.

I will start a timeline as soon as this starts to make sense.

Hola! And welcome to VJ. :)

RFE = Request For Evidence. If you get an RFE, it means they want more evidence to prove that you met or whatever -- they'll tell you in the RFE. An RFE means a delay in the process, but if you provide what they're asking for, it isn't a problem other than that.

"Touched" means that something was done to your file. It's nice to know that it got some attention, but that's all it means.

Recap: I sent in copies of my passports (3 total) and all stamps in them, showing I lived in India for 18 years. I also sent pictures of my fiancé and me together, dated. I then got an RFE requesting further evidence of meeting (post above). I sent in the following documents and within 3 days got the NOA2 approval.

Though my case is unique due to staying on in my fiancé’s country for so long, I list below the documents I sent that resulted in the approval, for everyone’s info!

1. Plane ticket and boarding pass showing flight from Chennai.

2. Travel Confirmation from Expedia.com.

3. Exit Permit issued by the Office of Foreigner Registration, Superintendent of Police, Anantapur, Andhra Pradesh, India.

4. Hotel bill while renewing my passport in Chennai.

5. Encashment certificates, with my name and passport information.

6. Applications for visa extensions.

7. Visa fees paid to the Government of India.

11. Certification from Karuna Society for Animals & Nature, where I worked in India.

12. Statement from my banks in India.

14. Copies of passports (AGAIN).

15. Photos of my fiancé and I (AGAIN).

I did email the lawyer and asked him about it, and he told me we´ll need one just farther in the process. Now I´m confused. Any help?

Wow, I´m confused. I know the all of the VJ have sent the letter, but my lawyers keeps saying the letter can be sent later on..i just checked the USCI website Application Procedures: Bringing a Fiancé(e) to Live in the United States, and the letter is not listed...Well, i would hate to get a RFE for that, but I guess we´ll have to wait, but I´m going to send the letter to my fiance right away.
