Timeline

We received a second RFE on August 25.

I got divorced twice but had sent in only the divorce certificate from the second, my last divorce. We really thought that would be enough and the guys with the CSC would be smart enough to know that Germany wasn´t a country where multi marriages at the same time was allowed.

Anyway, CSC requested the divorce certificate of the my divorce from 19 years ago! ! ! plus of course a certified and notarized translation.

There went another 50Euro...more than 60 Dollars.

Could bite me in my own butt that we havent´t thought about to also include those papers to our pertition in the first line already. well, another delay!

PJ, my baby from TX called them and asked the lady from the service hotline (for the first time she had someone on the phone who was friendly and polite and even helpful) if it was possible to send back the required papers per fax from germany and that lady got ahold of an office in CA who told her that would be fine. Well, we will have to see if this really will be fine or if we will get another RFE and the papers still need to be sent via air mail to TX and then via mail to CA. To fax the papers from Germany to TX has saved us at least 7-10 days.

We hope and pray now that was the last RFE we have gotten and we maybe will get approved before too long.

Now here's my case. First RFE was sent to us, it's just a questionnaire about international marriage broker, if my fiance's ever convicted in a court et.al..... My fiance sent back the questionnaire (the question form only) last June.....They sent an email to us they got the RFE reply last 21st of July.

Now they updated our case stating this (email):

On September 5, 2006, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 30 days have passed and you have not received the notice. Please contact the service center where you submitted your application during business hours.

M quite confused.....I don't know what this means. I've seen in the previous posts they are requiring some documents. Am I experiencing the same thing? Is there anybody who have the same case like mine?.....Hope I won't be waiting for months again for the approval.

Yes, it is a RFE . You will get a notice in the mail asking for additional evidence. When you know what they are asking for, please send it back to them ASAP. Mark on the envelope in red, " RFE " . Send it express so you can get a tracking number to let you know it was received. It would not hurt to also put your receipt number on the envelope. That's what I did, and they got it with no problems. As far as a longer wait time, others have had their NOA-2 shortly after mailing in the second RFE, but every case is different, as you can see, I'am still waiting. Good Luck and keep praying. (F)

On the 14th September we were asked for 2 nd RFE ...however, we got the additional information from our congressman Costello today( God Bless U! ) ....we waited 14 days just to find out that we need to send a certified copy of my fiance divorce papers.... this is all.....Todd and his ex wife forgot to sign the document...hehehe( isnt that funny) the judge did... it will be certified by the court clerk today and he will fed ex everything to USCIS tomorrow..This process its too complex for someone whos purely in love..What a waste of time.........they are playing with our hearts and our brains!!! ...Waiting..waiting ...waiting....i hate this word!

Tom sent a priority mail BOX of evidence of meeting in person and got approval in less than 30 days, here is what I sent:

copies of my airline tickets, receipts and itenerarry

copies of my hotel receipts

copies of my luggage tags

copies of my boarding passes

copies of my receipt for the engagement ring

copies of my passport with Thailand stamps

4 photos of us together

All this was sent for 2 trips I made to Thailand in April and July of 2006

The RFE specifically requests copies of bank statements or credit card statements showing withdrawals and purchases made in Thailand that include my name, location and full date.

I don't care what anyone says MORE EVIDENCE IS BETTER, THE MORE THE BETTER!

Maybe some of you have been approved with less than what I sent, and maybe it depends on who the person who is assigned to your case, maybe other factors play a role, but I am convinced beyond doubt that to send 'too much' is way better than not to send enough!

I will be posting this to the RFE thread also.

They also want more details on how we actually met.

I don't understand. You sent all of that information and then got an RFE for you to clarify the unsolicited information you sent? And this is good? And you encourage others to do the same?

Did you know that Adjudicating Officers are required to look at (and then vet and evaluate) every item that you send in? Did you know that sometimes the evidence raises more questions than it answers?

Did you know that Adjudicating Officers are required to look at (and then vet and evaluate) every item that you send in? Did you know that sometimes the evidence raises more questions than it answers?

More than one person who have used immigration attorneys have said that they were told to 'bury them' with evidence.

Clearly thre are two schools of thought on this. I am of the opinion that it depends on a factors to which we are not privy, which may include different standards being applied depending on the country of the beneficiary, or just the particular opinion of the person reviewing the case. I suspect a combination of both. I honestly don't see how anything I sent would have sent up any kind of 'red flag'.

I figure if you send them every scrap of evidence you have, it leaves them nothing else to ask for. The fact that Tom had to use a Priority Mail "BOX" to send all of his "evidence" and was approved in less than 30 days, is proof enough for me that it does not 'slow the process down' when you send alot of information to them.

I got my first RFE and it asked for 3 things.. 2 had to do with the fact that we filed the I-864EZ form.. that didn't go down too well, so they requested that we file the I-864 form, which is fine, so we sent out all the same info again, W2's, employment letter, etc.

BUT

They asked me for evidence of current nonimmigrant status since I didn't supply them with an I-94 number.. but the thing is, I never got one as a Canadian Citizen.. and so I was told to write a letter explaining this.. has anyone else had this RFE? Did you write a letter? This is the letter I wrote... should it be alright?

Any advice?

To Whom It May Concern:

This is a letter of explanation regarding the RFE H.(1) received on the 5th of October, 2006. I have been asked for evidence of my current nonimmigrant status in the form of an I-94 Arrival/Departure Record, or a copy of the nonimmigrant visa page of my passport showing admission to the United States.

As a Canadian Citizen, I am not required to have my passport stamped when I cross the border into the United States and do not require an I-94 Arrival/Departure Record. I was inspected at the border and showed my passport to the officer, and was allowed to enter the United States. No I-94 was received. I entered as a visitor and my point of entry was Alexandria Bay at the Thousand Islands Bridge in the state of New York on July 4th, 2006.

Furthermore, I consulted with an immigration officer at an InfoPass appointment at the Baltimore District Office on the 11th of September, 2006 at 1pm in the afternoon. The immigration officer my husband and I consulted with advised that I should write “No I-94/Canadian Citizen” on the I-485 form where it asks for the I-94 number. We were told that as a Canadian Citizen, I was not required to have one and she looked over all of my documentation and advised us to write “No I-94/Canadian Citizen” in any place where I was asked for an I-94 number. It was explained that this was common procedure for Canadian Citizens and that it was the correct way to file the I-485.
